Hi

I am usa citizen and my fiancé is Indian citizen. We are planning to get married and then file for k3 visa, but I wonder why is it required for me to stay in India for 2 months for getting my spouse to usa ? I also heard this rule will be changed to 3 months staying. Is there anyway, can I avoid staying too long abroad since that will result in job loss?

Will it make any difference if I am dual citizen (usa+india) ?

Pls let me know. Thanks for your input

If you are going for the K3 visa, the amount of time you spend in India after the wedding is not relevant to your filing (although some might say you need time to get the marriage certificate through all the red tape in Indian government).

If you want to do DCF (Direct Consular Filing), the rules for filing in India changed as of last June. It use to be that you had to stay 3 months and then can file directly from India (rather than waiting closer to 6 months if you filed from the USA for the K3). But the Indian Embassy now requires you are an actual resident of India in order to file for DCF.

P.S...how are you a dual citizen? Are you talking about the PIO card?

Feb. 02, 2007 - Sent Form I-130 via Certified mail

Feb. 05, 2007 - NSC Receives Form I-130

Feb 07, 2007 - NOA-1

Mar. 15, 2007 - Touched

April. 11, 2007 - Touched

April 17, 2007- Approved!!

May 01, 2007- Touched

NVC Processing of I-130

April 27, 2007- Received by NVC

May 14, 2007- IV Bill and AOS fee bill Generated

May 22, 2007- Sent AOS fee bill

May 27, 2007- Received AOS fee bill in mail

June 11, 2007- Received I-864 package in mail

June 14, 2007- Still no IV bill. Called NVC so that they can resend it.

Thanks for all the helpful information guys..to reiterate if i do direct filing then stay is 6 months in india?? whereas none from usa..so how long is the wait in k3 from usa? pls bear w/ silly q's

well there is no advantage as per now since the residency rewuirement has become six months for dcf,

earlier the requirement was for 3 months that was very advantageous

but the indian gov keeps changing policy who knows next month again they hang over to 3 month staying requirement u pls do keep checking the website

it is byfar better to do k-3 directly from u.s
