Hello people, lets start this week with more questions and suggestions :D. What is your thought about my fiance keeping her last name when we marry? Do you think it might hurt our case when we need to apply for AOS and they will see that she didn't take my last name?

If you had the desire to take his last name you could. The best time to make the change is when you file your completed marriage license after your marriage.  Your name is officially changed when the marriage certificate is issued.  Or leave yours and his as they are. Your choice. He isn't required to change his name.

If you change your mind later on then its a lawyer and filling through the court system. $$$$$$

I had sort of the same question today. So you think it wouldn't cause any problems to have our AOS approved easily if my fiance (female) decides to keep her maiden name when we marry and file AOS with her maiden name (which is how we have filed everything previously)?

Did you miss this "Or leave yours and his as they are. Your choice. He isn't required to change his name." ??

How do you apply for the SSN?  We downloaded the I94 form.  But, don't know where to start to apply for the SSN.  We tried to go into the actual website, but it is a bit overwhelming.

In NYC you have to go to a Social Security Administration office to apply for your card. There’s no way to do it online.

I applied for it two years ago when I came with a J1 visa. So that’s why I didn’t have to do it this time. I only changed my name on it after the marriage.

Hope it helps

I know this question is going to sound really dumb, but I will go ahead and ask it anyways. The form I-485 for AOS is filled out and signed by the Beneficiary and all the information about him/her correct? I assume the petitioner (me in this case) no longer plays a role in these forms (aside from the Affidavit)?. We just finished filling it out today ( as much as we could) and answered all the questions that apply to the applicant with her information (she being my beneficiary who is marrying me).

Thanks in advance!

This is the most I was able to find.  Even though it looks like it links some pages, when you click, you are unable to see the form.  So, I would say, just go to the local SSA office with your fiance and bring the passport with the visa, an another form of ID, and the I94 form.  Then, let the office take you through the forms.  So weird!  If I find anything else, I will let you know.

There isn’t any way to do the SSN card online. You have yo do it in person.

You can fill the form at the SSA office. Once you are in there, a officer will tell you to fill the form while you wait to be called.

You only need to bring I-94 and passport. For the name change bring the marriage certificate.

You are correct. The beneficiary signs all the forms. The petitionary only signs the Affidavit.

  1.  I-94 Form: you download it from the gov page. At customs they register your entry on that form. You need this paper to get an SSN#, AOS, EAD and AP. The trick here, is that this form expires 7 days after your arrival (not the Visa, only the validity of this I94 Form) so you MUST process your SSN# before it expires. If not, you will get lots of delays.
  2. SSN#: You are told that you must wait 1 or 2 weeks since your arrival to apply for an SSN#, so you give time for the system to pull up your data. And also apply before the 90 days expire. I've apply one day before my I94 Form was going to expire, and the system was down so I will need to wait a month to receive my SSN# with my single name.

OK, so this is what is throwing us off.  We DID download the i94 prior to expiring.  But, if the suggestion is to wait 2 weeks before applying for the SS# so the information is in the system, why does it also say that you must do it before the i94 expires?  Are we missing something? @Greenbaum

That is older information.  Currently a few days after arriving go to a SS office and begin the process of attaining a SSN. Then after marriage return to do a name change.
