@Fer Schvarztman Any news on the interview?  I have plenty of people that I have seen from NY getting their interviews scheduled.

Unfortunately not...nothing at all, the last time I asked for my status they said there is nothing I can do at the moment, they are not reviewing my case yet 😔

I think I will not have it scheduled this year.

Also when I renewed my NYC ID at the DMV office they only let me do it until my EAD expiration date Jan 2021. I don't know if this also happened to anyone else.

Now doing my paper work to renew my EAD.

Same thing here Fer.. they only gave me my license until my EAD expiration date.

I also opened a case because of the time that it´s taking to process my AOS and they told me I would have an answer in 30 days.... Today they resolved the case but the status is the same "pending interview". I guess we'll see.. If I don´t get anything in the following month I will have to start to get ready for the EAD renewal as well.

Bummer!  Yes, my husband's was also issued only until the current EAD/AP are valid (February 2021).  We will be sending our paperwork by Friday (hopefully) for the renewal.

Please I would. Did you have to send your EAD with all the paperwork? Also did you sent both EAD and AP papers together? Did you have to pay for the AP?

Sorry for the tsunami of questions 😅

New update about the Public Charge Rule. Seems like everyone submitting AOS after October 13th will need to add the Form I-944 Declaration of Self-sufficiency and I cuote from the article (will add link at the bottom)

"In practical terms, this means individuals applying for U.S. permanent residence will now be required to submit Form I-944, Declaration of Self-Sufficiency, along with their Form I-485 applications. USCIS confirmed that beginning October 13, 2020, the agency will reject Form I-485 if Form I-944 and supporting evidence are not included."

The article starts with GC applicants with working visas and at the bottom talks about family based GCs. The article is based on the October visa bulletin released.

My question is if we, the ones waitting for the interview also have to fill out the form. If someone knows something about this will be great.

From what I know, this does not apply to pending applications that fell prior to the rule ever taken place.  So, yours or ours does not fall within that, even though we are waiting on interviews.

Will post it later for you. I sent a copy of the combo card. EAD/AP packets mailed together. No need to pay for either. Just mailing fees.

I was under the impression  that the I-944 was required now and that they backdated the requirement. It's listed on the USCIS what they want. It's  been changed so many times I dare not give out wrong information. Just go to the website. That article is not from USCIS.

Got it. It is my understanding that it was retrospective for those that fell in between (when it went into effect and injunction, then reactivated). But, for anyone prior to it being the law, it is not. I will search.

Here is what is on the I-944, Declaration of Self-Sufficiency USICS page with the rules:

ALERT: On Sept. 11, 2020, the U.S. Court of Appeals for the Second Circuit issued a decision that allows DHS to resume implementing the Public Charge Ground of Inadmissibility final rule nationwide, including in New York, Connecticut and Vermont. The decision stays the July 29, 2020, injunction, issued during the coronavirus (COVID-19) pandemic, that prevented DHS from enforcing the public charge final rule during a national health emergency.

Therefore, we will apply the public charge final rule and related guidance in the USCIS Policy Manual, Volumes 2, 8 and 12, to all applications and petitions postmarked (or submitted electronically) on or after Feb. 24, 2020. If you send your application or petition by commercial courier (for example, UPS, FedEx, or DHL), we will use the date on the courier receipt as the postmark date.

So anything postmarked before the 24th of Feb is not required to submit a I-944, Declaration of Self-Sufficiency.

@Fer Schvarztman or @andreaam Do you have an actual checklist for things to take to the actual interview?  I have a list going but I want to make sure I am not missing anything that I could be taking to show the last year and few months.  Obviously, I am taking all of the packets (K1 through renewal).  But, I wanted a list of things to show the bona fide marriage.

Hey! I shared a while ago in the July AOS fillers thread my check list. I will paste here what I shared. I added proof that are not on the USCIS notice, hope this helps you @Fe.Ta and any other folks. D. Joint Asset: SUV ( We need to do the registration title application to show co/ownership). Not sure if we will add this, the SUV is still under my brother's in law name and died on us, so we have to sell it so...I believe we lost another proof.

E. Amazon Prime Household Account Screenshots with our names, picture and home adress + our orders delivered to our home adress.

F. On Going Relationship Pictures. ( Pictures since my arrival in April 23, 2019 until December 25th 2019, need to update till present).

G. Marriage Day Pictures at the Clerk office.

H. Social Media Posts. (Added posts since my arrival to NY from my FB page, my husband's page, brother and sister in law pages and my family members to show we relate in social media, we know eachother.)

I. Marriage Wittness Letters ( This letters basically say my brother and sister in law assisted in person to our wedding at the NY Clerks office).

J. Proof of Adress:

A. Family Letters we received when we got married.

B. Health Insurance payment letters under my husband and I name and adress.

C. Internet bills under my husband and I name and adress.

D. Fedex Envelopes + Bank Letters where our debit cards came in.

Despite all the proof we have, the most important such as the rent lease and the joint assets are missing and don't have much pictures together during the quarentine, at least a couple of family video chats through whats app. Hope all we already have is enough in case we have an interview.

Still, I believe we must think of explanations regarding our red flags.
