Hey all...  so we got hit with the Birth Certificate RFE as well. We provided the Acta de Nacimiento with the certification from Registro Civil and Apostille document as well (4 pages total: Page 1 is the digital copy of the Acta; Page 2 is the Additional Signature's Page; Page 3 is the Record Certificate Delivered; Page 4 is Apostille).

Our RFE is 3 pages long, asking for us to submit a copy of the birth certificate (which we did, with the English translation we got done by "Day Translation" online service.)

They included a 3rd print out with this information (that you can also find on the travel.gov website). They highlighted two areas on this third page (red, bold below). Looking through all of the pages, I don't see anything that officially reads verbatim "es copia fiel del original" on these 4 pages. The 3rd page with the stamps, blue validation stick, etc. only reads "CERTIFICO que el presente documento es copia fiel de las constancias obrantes en el módulo Registro Civil Electrónico del Sistema de Administración de Documentos Electrónicos del Gobierno......"

I can't imagine that the slight language change of "del original" versus the long form translation of this saying this true proof of the document found in the Civil Registry would result in USCIS not accepting the Acta.

@andreaam @Fe.Ta We were just going to send a copy (again) of the Acta we have and the translation. Any other advice on things to add? Was the Acta/certification language similar for your's?

THANK YOU SO MUCH FOR ANY HELP!!!!!!!!!!

Birth

Fees: No fee is required unless the certificate is requested by a judicial authority.

Document Name: Acta de Nacimiento.

Issuing Authority: Civil Registry (Registro Civil) of the municipality or rural area in which the birth occurred.

Special Seal(s) / Color / Format: Birth certificates have no security features as they are a copy of the book where they are registered.  Each copy must have a blue or black stamp with a legend stating “es copia fiel del original”.

Issuing Authority Personnel Title: Must contain stamp and signature of the registry’s authority.

Registration Criteria: There are no registration criteria.

Procedure for Obtaining: Procedures vary depending on the province/ registry from which it must be obtained.

Certified Copies Available: Certified copies are available

Alternate Documents: There are no alternate documents.

Exceptions: None

Comments: There are two types of birth records.  The "Acta de Nacimiento" is the official birth entry and should be used in place of the "Certificado de Nacimiento." These are obtained from the Civil Registry (Registro Civil) of the municipality or rural area in which the birth occurred.  If documentation of the birth is not available, the National Civil Registry (RENAPER) will issue a lettercalled “Certificación de datos

I am sorry for the late response.  But, I am going to answer anyways for others to have the resource.

The RFEs for birth certificates have about 2-3 different letters (mine had a different wording than Andrea's for example).  However, per my research, it seems that if they mention birth certificate, and you know the one you submitted is the only valid and official one per the original issuing government/country, then all you need to do is resubmit the birth certificate with its translation.  No need to find any additional or alternative.  In the case of Argentina, we know that the Acta is the only one they have, so no need to go bonkers.  Personally, I added the following cover letters (attached) along with the same birth entry documentation I added in the original AOS packet (along with its translation).

My assumption is that besides the workload, the fact that they lose things, etc., they are also making sure the birth certificate is not falsified.  In other words, someone that may have faked a birth certificate entry is likely to freak out or find another way to submit other birth documentation when hit with a RFE for that because they (the applicant) know themselves the thing they submitted is not valid.

Thank you to all that have shared their experience and keep answering one another.  We are sorry we have been semi-absent, but we are trying to stay as active as possible, work has just been busy and we are taking care of family.  Still praying for all of us as we move forward and best of luck to those who come.  Our case changed to ready to be scheduled for an interview about 2 weeks ago (don't remember if we shared or not), but we are sure it might be a while, since Orlando takes a while.

Thank you so much for getting back to us @Fe.Ta! The Cover Letter was a huge help to us!

I agree with you on why the RFE's are going out on this. Also, maybe something in their system isn't scanning accurately or seeing the correct "verbatim" input to ensure the Acta is true since I did see more than just Argentinian filers getting this RFE recently. Not sure if a system update is causing a kick back or something right now. It certainly is a hassle and makes one second guess what could have gone wrong when you are just waiting for the RFE letter to show up in the mail. Hopefully our's will be quickly resolved!

I'm excited to hear about your case updating, that's so awesome! Fingers crossed that it is only smooth sailing here on out 🤞❤️

Hope everyone else is doing well, too!!!

Hi, guys! Thank you for sharing your experiences. It's very helpful. I have a couple of questions.

The doctor seemed to mess up my i-693 ( I didn't notice at the time ) because the one she handed to me is only one page and some parts of it are missing. We know there is another one in the packet but we are not supposed to open it but when I got to the states, the immigration officer didn't open out my packet or anything.

1) Can the fact that the officer didn't open up my packet bring me problems?
2) If not, should I open the packet and take the i-693?

Never open the packet.  Contact (email) the doctor so she can scan and email you a new form.  Then, have a family member get the original and mail it to you.  This would be the best option (in my opinion).

what do you mean the officer didn't open the packet? Did they not keep the packet and handed it back to you?

Today my husband (from Argentina) and I received an RFE to our I-485 for a birth certificate and English translation. I don't understand why they're sending us an RFE when our original packet had the Acta de Nacimiento and a translation, which I did myself (fluent in English and Spanish) and had notarized. The only thing we can think of is that our photocopy of the Acta de Nacimiento was not a good one...it was a photo taken of the original and scanned into our computer. Could this be the problem or am I missing something? Has anyone else received an RFE for the birth certificate and translation when you already submitted both?

Yes! Today I went to a Deferred Inspection Office and handed the packet out.

I have another question about the medical forms for the AOS. Did you guys have to certify the Form I-693 by a civil surgeon? And what does  "If overseas medical expired" mean exactly? How can I check?

Thank you again!!

There are several of us that got that. Please see a few posts (from today) that share how to handle it. Just resubmit the exact same thing and include the cover letter I shared this morning with the documentation and a copy of the RFE. We don't know why they are issuing these.

Hmmm I am going to let someone jump in on the I693, since we did a new medical in the USA and we didn’t fill this one ourselves.

A medical is considered expired if it is past a year since you did it. When did you do yours? When are you planning to submit your AOS packet?

I did my medical around November and yes, I'm planning on submitting my AOS packet soon!
