Question about the EAD. We went this week to the SSA to file for her SSN. In the EAD application there is an item that asks if you want to also file for SSN. Should we mark no and explain why not and give them the reference number they gave us at the SSA? 

 

Any help is appreciated!

Not sure about the answer. Sorry! Maybe you can try in a general forum for that. Try Aos July filers 2019. 

 

I got my SSC with my married name (I already had my SSN, I only had to change the name on it after we got married) after  25 days. I’m in NYC.

Hello!  So glad to see everyone moving along!  We got his SSN over the weekend.  YAY!  Planning to get married August 7th or 9th.  Will continue to work on the rest of the paperwork to get the license and all the AOS things completed to mail after the marriage happens.  Question:  If we mail everything let's say by the 20th (1 month and 4 days prior to the visa expiring) is that enough?  Or should we be worried or try to do it sooner?  Thoughts?  I may have more questions coming up!

February 2020 - EAD/AP approved and got the card

October 2020 - EAD/AP renewal filed

November 2020 - EAD/AP renewal approved and got the card - AOS interview date issued

December 2020 - AOS interview, approved, and GC received

September 2022 - ROC filed
June 2024 - Biometrics Reused
July 2024 - Approved (NO INTERVIEW) and GC received.

You can file for AOS whenever you want. It doesn’t matter if your visa expired or not. K1 visa is a single entry visa. The visa expiration date is only for you to tell you to get into the US before that date. AOS is not attached to that.

 I don’t know if I’m being clear enough. Please tell me if you understand

Right.  I've always understood that.  I am also sure that we only have 90 days to marry (in our case until September 24th).  But, I was confused as to whether or not the AOS does need to be completed and received (with NOA1 included) prior to the 24th or if we are OK with marrying, prepping, and mailing by the 24th without NOA1 until after.

I know this has been answered but I'll give my 2 cents.

 

The way I understand it is you have 90 days to marry as soon as the beneficiary steps in the US.. Once you marry you file for AOS whenever you can. Even if you file when the visa has expired I don't think it matters because the visa will be expired while the AOS is in process if you filed during those initial 90 days.

We Received hard copy NOA1 July 23rd after receiving the text message on July 18th. We sent everything on July 11th and they received it on July 15th. We actually mailed it at the end of June but the package got lost in the mail.

Hello all! I have a bit of a dilemma.

 

My fiance got his visa approved and he is now in the US with me, he arrived here two days ago.

 

The problem is, his acta de nacimiento was not apostilled and translated while he was in Argentina because we both didn't know that was required and the real kicker is that he has no family in Buenos Aires to say, send it to and have them do it for him.

 

So what has to be done for his acta?

I hope someone can help me because we're both freaking out about this and our wedding is in less than two weeks.

I apostilled my acta just in case before coming to the US. But when we were getting AOS ready, we read on the USCIS website that all foreign documents don’t need to be apostilled or had a sworn translation.

The only thing you need is a certified translation l. This can be made by anyone that is bilingual. After you translate it, you have to sign a certified letter saying that your translation is correct.

"(3) Translations. Any document containing foreign language submitted to USCIS shall be accompanied by a full English language translation which the translator has certified as complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English."
