RFE on household member contract

Timeline

I called NVC today and asked an operator about the RFE she informed me that it was because I had not submitted proof of my relation to the household member. She also told me that a household member has to be related. I didn’t know this so now I have to send a copy of my parents marriage license to prove that my household member is my stepfather. This Blows ! :angry::crying::(

4/20/2007-NVC replied re: DS3032 and DS230 bill generated

4/23/2007-Sent AOS Bill payment overnight (james Shortcuts)

4/24/2007- NVC recived AOS $70 payment

4/30/2007- Recived IV Fee bill

4/30/2007- Payed IV Fee bill $ 380.00

5/01/2007- AOS Generated

5/01/2007- NVC recived IV Fee Bill Payment.

Have you received the RFE by mail? Follow the instructions and take care of it. Good Luck!

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I agree that's a good intention and it's something that should be done. It was only the RTFM that I objected to at all.

NO it was not MY OWN FAULT. I didnt fill out the application I had a lawyer do it. It was his job to let me know what I needed thats what I payed him for. I Have done everything myself the only thing that I had a lawyer do was the affidavite because I wanted to make sure that everything was done right and it turns out that its the only thing that his been returned to me. I trusted that him being a lawyer whould of known what I should send.

I agree that's a good intention and it's something that should be done. It was only the RTFM that I objected to at all.

NO it was not MY OWN FAULT. I didnt fill out the application I had a lawyer do it. It was his job to let me know what I needed thats what I payed him for. I Have done everything myself the only thing that I had a lawyer do was the affidavite because I wanted to make sure that everything was done right and it turns out that its the only thing that his been returned to me. I trusted that him being a lawyer whould of known what I should send.

O and by the way I just read the instructions and it says that you have to be related but no where on their does it say that you have to submit proof. And on my fathers tax returns (all 3 of them) it shows me as a dependent and says daughter and my SS Number. Thats sounds like proof to me.

Page 2 of the instructions, under Step-by-Step Instructions for Part I, item 8. In the 2nd paragraph:

"If you check any other relative except for spouse, you must provide proof of the relationship and that you have the same principal residence as the sponsor."

Perhaps the USCIS case officer wants more proof of relationship than a tax return, the primary purpose of which is to provide financial information.

If anything, this proves that lawyers don't always do things correctly -- which has been proven time and time again here on VJ -- and it behooves anyone who hires one to know exactly what should be done, even if the lawyer will be the one actually filling out the forms.

Just send NVC what they are asking for.

You'll be ok Miriam, nothing to be upset about. They'll finish processing your case at the NVC as soon as you send in what they want and then you'll be a step closer to being with your husband. Just think, you're so close to getting there, unlike so many of us who don't know what is going on with NVC.

Miriam... hang in there girl. Like a few others have said, just send exactly what the RFE asks for and you should be just fine. It delays things a bit, but real soon this will all be over and you will be with your hubby here in the US. Good luck!!!

03/13/07: NVC sent packet to La Habana

03/27/07: Telegram "sent" to fiance to pick up packet 3... never received

04/02/07: I contacted the "embassy" to find out status of case and set up pick up date

04/04/07: Fiance picked up packet 3

04/05/07: I called toll-free # here to set up appointment for my fiancé

05/10/07: Interview scheduled for 7:30AM... Visa Approved!!!!!!!!

05/14/07: Picks up passport/visa and brown sealed envelope

05/15/07: Paperwork for the carta blanca turned in

05/24/07: Carta Blanca received and bought plane ticket

06/04/07: Entry into the US... together again!!!!!!!

08/07/07: MARRIED!!!!!!!!!!!!!!
