Everyone is recommended to file within the first year to avoid needing to do another medical (k1 visas). Until USCIS publishes a policy letter with a timeline or addressing the “gray” area. You’re not wrong or right by waiting or not. 

A person whose I-94 has expired is subject to deportation....until such time as they file the I-485 and gain "authorized stay"..which is not a legal status.....take it or leave it!!

That applies in the quoted case as well as all K-1s.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Not wishing to double down too much, I guess it depends what you mean by dangerous, I would not want to be in that persons position, arrested, jailed so I would consider that being in danger.

 

My assumption is that most people do file within 90 days, seem to see more filing very early, most want to Drive, Health Insurance often depends on Marriage.

 

There is no grey area, it is black and white and has been for a very long time.

The issue is risk.  The risk of many situations -- all bad -- is increased by failure to file AOS as soon as possible.

The purpose of this entire website, in fact, is to educate others in order to minimize their risk.

Accordingly, let's please stop suggesting that untimely AOS filing is a "gray" area because of no published rule.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I feel like this argument  discussion is being a bit misunderstood. It is important to know facts, so individual can make their own decisions about their case. We do not know their situation, or why they are asking a question. As long as they understands the risks, and prepared to deal with them, it is their lives and their decisions.

I would not advise anyone to delay AoS, and we filed it as quickly as possible  after getting certified copies of the marriage cert. But to @BB Familypoint, stating that AoS CAN be filed after the 90s days is merely stating facts of the case. One should try not to be in position of filing late as there are risks stated multiple times over, but if someone somehow ends up missing the 90 days date, they still CAN and should file as soon as possible if they intent to stay legally in US.

It's about giving advice which helps people make informed decisions.  Telling someone "What’s important is getting married before the 90 days expire. There is no time limit on filing for AOS. " is not giving all the information  required to help someone to make a fully informed decision.

What kind of evidence if any did you all include in your packets besides what is required?

No need to include anything extra. You just need the marriage certificate. Get the AOS in ASAP and you can take more evidence to the interview! Trust me, you'll have plenty of time to gather more evidence while you wait for your interview...
