So I called them last night and after being on hold for over an hour they basically confirmed that it must have been their mistake and now we just have to send it all back to them..... 😞  So, we're going to do that today... Our plan is to attach a letter explaining what happened and send back everything exactly as they sent it back to us and include another copy of the I-485 just in case with a new signature and everything... My check was also returned so I think I'm just going to send that same one back to them.... Feeling so sad about this.

SO SO sorry to hear that happen to you!

BUT! It's great news it was their mistake, the delay is only a couple of days and y'all are on board again. Keeping fingers crossed for you guys!

 

Yesterday I got 3 texts between 10:57 and 11:20 pm confirming that our cases were received. Our paperwork was delivered on May the 4th so it took them 5 days to notify. Awaiting hard copies now.

Same here, AOS filer, sent package on the 8th. received today, may 10th. Sent with USPS priority mail, though it was goint to take longer.

The setback is disheartening, but at least they returned your check and you won't have to deal with a financial blow as well... I hope everything goes smoothly for you from now on!

No, you don't. It is a good idea to, but you can file it later. Some people file it years later. Once again, I am not saying this is a good idea, there is a story about someone who got arrested due them being involved in traffic accident, and having expired I-94, no state ID, and no AoS on file. So by delaying you are running a risk. But you will not be denied Green Card solely due to filing after 90 days. You DO have to get married within 90 days.

No. You can file at anytime. What’s important is getting married before the 90 days expire. There is no time limit on filing for AOS

This is dangerous advice, imo............ Once an I-94 expires, the person is out of status and technically subject to deportation.....once the person files the I-485, he/she gains authorized stay while the I-485 is pending........AOS should be filed prior to expiration of the I-94.  Please read the following recent thread from @SpaceAge

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There’s probably more to that story. Regardless there’s nothing that started anyone has to file within 90 days. Some people don’t even get married till day 89-90. No matter when you file.. you should always keep a copy of your documents on you. Even as a citizen if I leave my license at home and get pulled over the police officer isn’t going to let me go home to prove I have one. So no one especially anyone in any “status” would be allowed to do so. In this event I’d advise full compliance with any officer and don’t argue regardless of your status. Don’t resist attempting to prove your status until said time as such is appropriate. Also saying she’s unable to work due to sending her EAD off?? Why would she send the actual EAD? I’m sure you send copies of said documents. Not to mention why wouldn’t she have worked prior to “sending it off” there’s a few things not adding up and I’m sure plenty missing from this story. So it’s not dangerous advice telling someone they don’t have to worry and freak out if they haven’t or aren’t filing within the 90 days. Most people don’t. Some can’t. That’s the way it is. Everyone is recommended to file within the first year to avoid needing to do another medical (k1 visas). Until USCIS publishes a policy letter with a timeline or addressing the “gray” area. You’re not wrong or right by waiting or not.
