Ok, so we are thinking we need it for the AOS package- you are saying we don’t?? Which would make sense because obviously we were approved, he moved, and we married within 90 days. I feel like everything I’m reading says we have to send in a copy of I797 approval notice with his AOS application; hence the freak out :(

I encourage you to read the I-485 instructions.  There are 7 specific references to the I-797, NONE relate to an AOS from K-1 application

YMMV

Checklist of Required Initial Evidence for Immediate Relatives and Family based Preference form I-485 Applicants:

  • Documentation of immigrant category, such as a copy of Form I-797, Approval or Receipt Notice, for the Form I-130 filed on your behalf (unless you are filing your Form I-485 with the Form I-130 filed on your behalf)

So is this only required for people who did I-130??? What would be Documentation of Immigrant Category for us (Form I-129F)? His I-94?

Really appreciate your help here!!

The I-94 is one.  A photocopy of the visa and entry stamp is another

Thank you! I cannot be the only person confused about the wording on the website. Regardless, we don't have the I-797 in hand so I hope we don't get an RFE for it. We have literally everything else, our case is very straightforward.

Thanks for your help here!

Life is too short to worry about and RFE for something that isn't required

Should be printed on the actual visa in the passport, I believe.

If you don't know it, then "Unknown" is a valid answer

Lol.

The I-797 for the I-129F was for the petitioner.

The approved K-1 visa put in the passport... is it's own proof of approval.

@TennantFamily The USC should have received a copy of the NOA2 from the initial I129F, and it would have included a copy of the approved petition.  My husband received this and then provided it to me, as I think I needed it for the Embassy part (though this 2016, so not sure if anything changed?).

After that, for AoS, I did NOT need anything from the K1 petition, except for a copy of the VISA in my passport and the paper i94.

I can confirm with 100% certainty it is not printed on K-1 from Ukraine. The WAC number IS printed, but not the the A number. I heard some other embassies do print it.

True! But I’d say we should also edit our own VJ guides if they’re off.
