Hello,

 

   I'm a US Citizen and I filed a GC (I-130) for my mom. It was approved a few days ago. She is NOT adjusting status within USA, but will be getting the GC in India. The next steps are that application will be sent to NVC which will ask both me (petitioner) & my Mom (beneficiary) for some documents. I'm waiting to hear back from NVC. From my side, I know I'll have to file I-864 (affidavit of support) and financial supporting documents.

 

My questions:

1. Are there some common documents that the NVC regularly requires for beneficiaries from foreign countries (India in this case) 

2. Will my Mom require Police Clearance Certificates from all states/areas she has resided in India since birth?

3. Will she require a clearance certificate from the India Passport department as well?

The PCC from the state that's she's living in should be more than adequate.  If she's ever been out of the country, it might take longer for her PCC to be issued.  

 

Also PCC is only valid for 1 year.  My uncle and his family had to have their PCC reissued 3 times because it took years for my uncle's PD to become current even after their welcome to nvc letter.

 

You mom should apply for a passport if she doesn't already have one.  If you'll applying for your dad, you'll need their marriage certificate.  

 

All other documents will be printed / scanned by you.  The only document that took me a while to obtain was my mom's tax transcripts.  I had to wait for a unique code to be mailed before I could create her irs profile.

Here's the list of documents I mailed to the NVC and had my uncle's case document approved within 2-3 weeks.

 

Petitioner's Civil Doc:

- Document Cover Sheet (From Welcome to NVC Letter)

- Form I-864 AoS (Signed and dated)

- AoS Payment Confirm 

- Current USA Passport 

- US Citizenship Cert

- Affidavit of Birth

- Past 12 Months Pay Stubs

- Past 12 Months Saving + Checking Bank Statements

- Past 3 Years W-2 + Federal Return + Tax Transcript

 

Principal Applicant's Civil Doc:

- Document Cover Sheets (Printed from CEAC site)

- DS-260 Confirm

- IV Payment Confirm 

- Current Indian Passport 

- Current PCC

- Marriage Certificate 

- Birth Certificate + Translation

Three questions:

1. Did you need to get a clearance certificate from the Indian Passport office?

2. For PCC, is there any standard format to follow? Or will the police have their own format?

3. In your mom's case, did you need tax transcript because she was in US? In my mom's case, since she will be in India, do I still need to get her US transcripts?

Sorry I should have been more clear but it's my mother who is sponsoring her brother.  My mom is the US citizen and petitioner.  My uncle and his family are Indian citizens and are the applicants.  I am just the one who gathered and mailed the documents...

 

1. Only my uncle and his family needed to get the PCC from the Indian Passport Office.  In your case, only your mom will need the PCC.

 

2. You can actually register and fill out the PCC application online for her!  along with paying the fees and scheduling the Appt.

I had my uncle and family take these docs to their PCC appt:

 

- Passport + Copies

- ID (PAN card, Aadar card, etc) 

- Proof of Address (Bank Pass book)

- PCC Application Receipt 

- PCC Appt Confirm 

- Welcome to NVC Letter 

- AoS + IV Fee Payment Confirms

- DS-260 Application + Confirm 

- Extra Passport Size Photos

 

3.  Since my mom was the petitioner of this case, I submitted her US tax transcripts to NVC.  In your case, since you are the petitioner, your US tax transcripts should be submitted to NVC.  If you have a co-sponsor, you'll need their US tax transcripts.  You do not need your mother's tax transcripts.
