If you do not make the income requirement, you can also use assets to supplement the difference though I've seen different numbers for either x3 or x5 the difference.

if i get a co sponsor does that person has to fill a i134 too?

yes they will, and you will also need a co/joint sponsor for the Adjustment of Status.

if you have assets you can use those to make up the difference but you will have to have 3 x the difference in assets.

You will need to check with the embassy to see if the will allow a co/joint sponsor for the K1 visa, some do not.

Good morning what is AOS? and if I bring all pay stubs showing that I am employed full time and that I do make more than what incometax shows? plus a work letter? and show my bank statements, because i dont have a joint sponsor.... and the only reason why my income taxes were low, was because all the traveling i did last year... which i have proof of

If you're working full time and make a salary above the minimum requirement, and provide those documents (recent pay stubs, employment letter), you probably don't need a joint sponsor since current income is more important than prior income. If your fiancee were asked about last year's tax return, and your current salary, it is easy to explain (took a lot of time off last year, but not doing that this year).

And as others have noted, some embassies are more picky about this than others. You might want to do more research into people's experiences with the embassy in Colombia.

While this works for K1 visa you need to be employed + have sufficient assets. For Adjust of Status you could have assets alone.

Your goal should be at least 22K/yr if you're going to be sponsoring someone. Or make very near that and have at least 10k in the bank *MONTHS* before the interview, if you throw it in last second there is a good chance that you won't suffice the consulate.

For the K1 the petitioner must complete the I134.. minimum requirement is 100% of household poverty line,  yes .. but the interviewing officer has sole discretion about what is actually required

For the Adjustment of Status , the form is I864 and the minimum is 125%... again dole determination by the interviewing officer

So, this makes me crazy. Why set guidelines to follow if they are going to allow the co to have sole discretion??

Because it is not just about numbers.  It is based on the totality of circumstances and the likelihood that the beneficiary could become a public charge and attempt to get benefits from a system which they haven't paid into, which is not fair to taxpayers.

The CO has discretion over other things (i.e. determining whether immigration fraud is likely), so why not the financial side of things?  Immigration is not cheap.
