I wasn't trying to be secretive but didn't see the need to ho that deep.  Besides, I'm  not sure how it would change anything. If doing an I-130 they would be f2 regardless of biological or not. Mom is still LPR and Dad is US citizen.

Rather than the 3 words “yes he does” in response to someone’s question about father’s consent, you could just have said the 3 words “father is deceased”. Relevant and correct info, nothing revealing, would have saved some time on behalf of various posters spending their free time here to try help people.

Uh... you said they were orphaned at birth. Your exact words. An orphan is someone who has both parents deceased.

It would have changed things in terms of required evidence/documentation/steps needed to immigrate the children.  

 

I think what @SusieQQQ was trying to say, is that you earlier wondered why it had become a topic of discussion...it wouldn't have become a topic of discussion at all if you'd just answered honestly "the children are adopted" instead of giving the inaccurate answers you did...members would have kept to the focus of how to immigrate the children, then, as any custody concerns would have been a non-issue.

 

It's cleared up so now hopefully you can continue get relevant information based on how accurate the information is that you provide.

To be honest I was just trying to move past the consent letter part because it wasn't important to this situation.  I was very surprised to see it went so far so quickly.  I think some even brought possible child smuggling or something like that.

 

In the end the parents gave consent when they abandoned them so I feel my answer covered the question.  I feel we the post got way off target when the subject went to applying the definition of abandon and orphaned.  Either way they were legally adopted and fall in the same category as they would if they were biological.
