Hello,

 

Quick question:

Is it possible to change the status of minor children (2 and 4) from B2 Visa to a (I-130) Petition of Alien Relative while they are already in America?  

 

Narrative:

I'm a DOD civilian and while on vacation in the States from overseas I received orders back to America.  Being it happened much sooner than we anticipated the decision was made to leave my family there while I came back and moved our belongings.  Now I am looking for the easiest/legal method to get my step children (2 and 5) permanent residence and eventually citizenship in America.  I would like to do this with us all together while also ensuring I don't break any laws that will prevent them from getting residence and citizenship in the future.

If the children are not already in the US, then it would be considered fraud to enter the US on a B2 visa with the intent to immigrate (adjust status).  You can file the I130 while they are abroad though.

Just wanted to mention, along with the great advice already given above---you will need proof of the biological father's consent and/or court order to permanently move the children to the US...so you'll want to keep that in mind as well and make any necessary arrangements.

You will don't need to do this because it is considered fraud to do it like this. But you can petition for them and have that petition expedited due to being a DAC. All you have to have is a copy of your orders back to the USA and use that evidence to expedite.

You're a DOD Civilian right??? A DAC is a Department of the Army Civilian but either way if you are a DOD Civilian then you can file for a expedite once you petition your step children.

Not a problem.... I am with the Department of the Army myself as a civilian. You basically as a DOD Civilian fall under the same pretenses as a service member. Can I PM you a question?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
