Timeline

My in laws were sponsered by my husband got their green cards 3 yrs ago. First time they stayed for 5 months and have been doing month visit each year. My mother in law has rhemotouid arthritis and she is getting treated in india. This time around at port of entry they were questioned on why they go back. Her medical reason wasnt valid. They were told to either abandon their greencard or seek rentry 2 yr permit. How long is this processed in? My mother in law has surgery scheduled in mid june so they have to return. Please advise on what to do in thjs situation. They will eventually settle here as he is their only child but for now they are independent and prefer medical treatment in india, as it is too expensive here. Please advise

They cant have cake and eat cake. 

 

They were already WARNED and that warning is in immigration system. Next time they try to use green card like a tourist visa, they will be in troubles. Short and simple. 

 

If they weren't ready to move to the US then they shouldn't get green cards. Maybe better solution is to officially abandon their green cards and apply again when they are ready to move. Maybe reentry permit is an option for who knows how long they want to stay in India? 

 

Or suck it up, get good insurance in the US and find treatment there.

Sounds like best option is for them to abandon their green cards, and get son to re-sponsor when they are ready to move. 

i have to point out, that for most people medical needs get more and more as they age. If they cannot afford medical treatment now in the US, then one wonders how they will cope in 10 or 20 years time.

They got lucky, sounds like they need to decide where they want to live.

They have to be in the US to apply for the reentry permit. And get their biometrics done for the reentry permit. 

 

Sounds like they're visiting on a green card. Why did they get a green card to begin with if they're using it as a tourist visa? Were they previously denied tourist visa that led them to get a green card? We see that sometimes, IRs of USCs opt for a gc when they can't visit, then realize the hard way if they live somewhere else and enter the US only occasionally.

Timeline

Can they stay in the US, get the treatment here and apply for US citizenship as soon as they become eligible?. Once they become USC, they can travel back to India without having to worry about abandon GC issue. If they cannot do that, then I guess re -entry permit/ abandon GC is another option.

a yearly visit for one month is not residence , this is why they are in danger of losing the green card 

 

sure they can file a re+entry permit and decide, will probably take about a month to apply and to get biometrics, maybe 6 weeks, both those steps must be taken in US, after that they can go back and it can get sent to their closest consulate

 

 I trust they are filing tax returns with the irs every year right?

 

I am still worried about a question that was avoided ... the longer they do not settle in the US, the less they can build up in social security/Medicare. Will they be able to work a full ten years once they finally come to be able to at least partly access those benefits? If not how will they pay for medical care that will become more frequent and more expensive when they can’t even afford it in the US now?

Yep.. we see numerous folks sponsoring green cards for elderly parents tend to forget the cost of medical care in the US.
