MAY 2019 K-1 NOA2 ----> NVC

As a K1, when checking your case online at CEAC.state.gov you have to select "immigrant visa" as it is treated like as such even though it is a "non-immigrant visa".

 

Technically the K-1 is a non-immigrant visa but it is treated like an immigrant visa because of the AOS. It is kind of a ba$tard. Non-immigrant treated like an immigrant. Other non-immigrant visas do not usually end up with green cards!  The K-1 on its own is a single entry, short time limit visa that expires 90 days after POE. You are a non-immigrant (90 days limit) with immigrant intentions (GC). That is why it is a non-immigrant visa treated like an immigrant visa.

 

You have three stages 1) transit - shipment is in the air or soon will be, 2) received - physical case file is at the Embassy and 3) ready - your case is ready to schedule and complete your interview.  These will be your current state or status to your case file once you have received the case number.

I may have found an answer to my question.  I was able to locate the following information and thought I would share it.

 

Once entering the details, applicants will see the status of their petition. This status may appear as follows:

No status

This status is shown on online applications until the interview is completed.

Ready

The status indicates that information (such as photographs and fingerprints) need to be taken or that an interview needs to be scheduled.

At NVC

The U.S. authority has not yet opened the case or the DS260 form has not been submitted yet.

In Transit

The case arrived to a U.S. Embassy to schedule an interview. You can find out more about scheduling an interview by visiting the USCIS website.

Issued

The visa application is completed and approved in the final processing phase.

Refused

You can find out more about the refusal by contacting the U.S. authority that handled the interview.

Administrative processing

Further checks are needed. This process can take up to 60 days after the visa interview. If any documents are missing, the U.S. consulate contacts the applicant. Once this stage is complete, and your application has been accepted, your visa will be sent to you via mail in two business days.

Expired

This notification signals that your registration for an immigrant visa was cancelled. Any petition approved on your behalf was also cancelled. Your application may be reinstated if, within one year, you demonstrate that your failure to pursue an immigrant visa application resulted from circumstances beyond your control. Note that your registration record and any petition approved on your behalf, as well as supporting documents, have been destroyed and any U.S. Department of Labor certifications have been returned to your prospective employer. If you still want to pursue an immigrant visa, your petitioner should contact the U.S. Department of Homeland Security's (DHS) Office of U.S. Citizenship and Immigration Services (USCIS) to file a new immigrant visa petition. 

Expiring Soon

Section 203(g) of the U.S. Immigration and Nationality Act requires the cancellation of registration and any approved petition if you don't apply for an immigrant visa within one year of being notified to do so. If you do not obtain an immigrant visa during that time, and you fail to notify the USCIS that you haven't obtained one, your application and any petition approved on your behalf will be canceled. 

Your application can get reinstated and a petition can get revalidated if, within that one-year period, you can prove that your inability to get an immigrant visa application was due to events beyond your control. You'll need to give a written statement to the U.S. Embassy or U.S. Consulate that details those circumstances and notes that you still want to pursue a visa petition.

That would be odd since I need a case number to track it in the first place.  It could be no invoice id assigned yet but that is just a guess.  I am also thinking since I do have an attorney for all this (I know I could have done it without one but I wanted to be safe)  based on the info I found it is waiting on form DS-260 which I believe we fill out online and not the attorney, so not sure about that.

 

Sadly nothing any of us can do but wait.  However once I do find out I will share the information for your tool box of knowledge.

Like i said, the at nvc is the parking spot to which the case is assigned once it arrives.  It won't change till there is movement on your case like when it ships to the embassy.

That makes sense as I recall reading the status does not change until the event has happened.  So in theory tomorrow it "may" get updated to in transit since a case number was assigned already and the julian date was before the typical cutoff shipping date.

I might be wrong (and probably am incorrect). But, I think the K -1 visa uses DS-160...

Update: I called the NVC today and got my case number, it was assigned this morning according to the rep and according to the Julian date calculation. :)

Once you have your case number then you can complete the DS-160. Go to the first page and download the PDF file of tips, tricks and hacks and visit #14.

In my opinion.... I would take all of the documents from the trust....all of the payments made to your fiancé for the last year from the trust....and a list of future payments that the trust is obligated to make to your fiancé for the next year or two (the trustee is capable of doing that) Those documents should satisfy the consulate.
