Timeline

I believe it's safe to say that the dreaded RFE message/letter has haunted us at one time or another during the application process. However, I was doing the typical thing every partitioner does from time to time, (searching youtube concerning any valued i-130 information) and I came across one lady stating that the USCIS plans to deny more application that once would be considered RFE😨

.Hopefully, she is only referring to missing documents, I'm not sure if she is using this as a scare tactic, But RFE has always been like that annoying uncle you didn't want coming over for Thanksgiving. However, If he shows, you just deal with it. 😅

This has been discussed a few times on this site. RFEs are still being issued regularly.

 

They modified the policy for when to issue a NOID or outright denial. Previously, it required a "no chance" of qualifying for the benefit to be issued a denial without an RFE. This was modified to remove so-called "placeholder" submissions where somebody would submit a packet without all information and plan to get an RFE later, especially when certain documents were not immediately available, or just applications without merit.

 

That said, be sure to submit a complete packet. Any required documents should be provided or else you do risk an outright denial.

Missing supporting documents shouldn't result in an outright denial, but obviously it's best not to push your luck. The decision to issue an RFE or outright denial is still in the IO's hands.

 

RFEs aren't scary or something worth dreading. It just means they want more information. Provide what they request and then you go back to the waiting game. Usually, the wait after an RFE isn't too long for most forms of submissions.
