Aos approved ,question on the conditional green card

Timeline

Hi guys.My Aos was approved and i received my conditional green card today .I’m actually not happy cause i’ve read everywhere that if you wait 2 years for the approval you get the permanent green card right away .In my case its been 1 year and 11 months .Now ,do i need to wait 2 years to apply for the permanent one still? Should i get a lawyer involved for this? I feel its kind of unfair that i waited 1 year and 11 months and for a month they sent me a conditional one

If the marriage is under 2 years when AOS is approved, you get a conditional (2 year) green card. No way around that....it's law, not discretionary. You will have to file for ROC via an I-751 in just under 2 years.

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

7/13/2017: Interview: APPROVED!!!

7/19/2017: Visa in hand

Damn i feel so bad about it even tho i’m happy i got approved and everything but its like for a month they make me go thru the ROC and all the (removed) 😓

Yup the date on the card when issued is the day you became an LPR, not from when you filed for AOS. In under 2 years from now you'll proceed to ROC. Nothing can do about it sorry.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

An attorney can do nothing.  You correctly received a conditional Green Card based on the law........just start planning for your removal of conditions in about 2 years........Unfair?  hardly!!!  2 years is 24 months..not 23 months....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

There is no "play".......and in 2 years do not file your I-751 even one day late....if you do, it will be rejected........

One more thing:  My wife entered the US via a CR-1 visa 23 months after were married......and she, too, received a 2 year conditional Green card........and I didn't complain......

I’m asking ,your situation is diferent from mine so if there is a question from me then probably must be something behind it ,if you’re smart you would understand why i wanted to get the permanent one and get done with it 😉

That reads as though you think you’re entitled to something.  I know you’re venting, but I would be more aware of how things can be interpreted.  The system is what it is.  Some folks wait even longer, just to be reunited.

My friend got a 10 years green card and her marriage is 1.7 year old. She got approved after 1.4 months and left for the us after 1.7 months!! Where is the law then?

They make mistakes and it’s up to the person getting the green card to be proactive and fix it

Then she needs to notify the USCIS and have her green card replaced. She will get her citizenship denied based on this.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.
