:pop: Another OP not happy with legit answers given and trying to find shady ways to "play" or "game" the system. They need to realize immigration isn't guaranteed, it isn't a right, it's a privilege. Being a temporary visa holder in the US, no tie really for the spouse at home... They are better off petitioning their spouse to go to Canada.

I'm very confident there are people in similar situations. I'm certain there is nobody in the exact same situation.

The CO evaluated her set of circumstances. Asking for or accepting documents would be an outlier, not the expectation. That's certainly not limited to just Pakistan. As noted, the DS-160 + interview is nearly always sufficient for obtaining the relevant information to make the immigrant intent decision.

Seeing as the CO didn't ask for documents and isn't likely to do so in a future application - and there's no room for flexibility for how you answer questions on the DS-160 - I'm unsure what advice could possibly be provided to show stronger ties. The process intentionally doesn't provide that kind of opportunity. There would need to be some sort of material change in circumstances.

 

Visas (barring those with a lottery component like DV) are not a chance-based process. Sure you can get a CO that will evaluate circumstances in a different way, but relying on dumb luck will not go far.

 

It's possible there was another reason for refusal (I can't say what was in the CO's head), but the information available indicates lack of ties was the reason for refusal. Anything else would be speculation.

Consumer officer move from embassy to embassy. A few years here, a few years there. Like the military. It’s quite possible that the officer interviewing your wife had previously worked at the Montreal embassy. In any event, all non-immigrant applications must overcome the basic assumption that they are using a non-immigrant visa as a springboard to a permanent life in the USA. 

 

You sound like like an honest, maybe even somewhat naive, person as you believe that the fact that this visa applied for is temporary in nature will be enough to “prove” that your wife will return when her time is up. But there are hundreds, thousands, of people here who arrived on temporary visas and are still here decades later. Each one of them convinced not only the visa officer but also the CBP officer at the border that they had no intention of staying. The CO doesn’t know your wife from a bar of soap and has to assume she had the worst intentions.

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I got a letter of due consideration from congressman in my area so the inteviewing officer gave proper consideration to her case instead of just rejecting it without any good reason. Otherwise, there was no change in our circumstances.

Was it a US Congressman? How did you get that? I just got denied for the same reason 214(b). :(

Yes, a US Congressman. You can search for your local congressman and email/call his office.

The letter stated that we intend to leave USA when my TN expires and also mentioned the specific financial/family ties we have outside USA. My wife took that letter along with the supporting documents during her interview.

Could you please share the contents of the letter so I know what to ask of my congressman? Same situation as you, my wife recently (Jan 2024) had her TD visa denied (at Karachi) for lack of ties and from what my wife mentioned, the counselor didn't even know what a NAFTA professional is and kept cutting my wife off every time she tried to explain... It surprises me how they have so much power with such little care...

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
