clarification if ROC

Timeline

My wife came here on a K1 visa and we married. Then filed for her AOS and got a green card (CF-1) a 2 year card

 

1. Do we follow the I-751 process?

2. With all the delay fears being posted does it help to send sooner or just send so it arrives in the earliest part of the filing window?

3. to confirm the I751 window is 90 days not 6 months as we thought it was.

1.  Yes, you must follow the process for removing conditions if she has a 2 year conditional Green Card.

2.  I would advise filing the I-751 and supporting documents as early as possible after the 90 day window opens.  

3.  You can not file the I-751 before the 90 day window opens.  If you file it even 1 day early, it will be rejected.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I wouldn’t necessarily be fearful of a delay.  It’s a process and it takes a while, but unlike the initial visa to get to the US to be reunited, the i751 filing isn’t obstructive of your life.  File and forget it, until you have an interview or an approval.  Your wife can still work and travel as she is not out of status after 2 years, and with the physical card and the NOA, she has proof of that status.

 

As mentioned above, do not file before the 90 days, otherwise they send it back and I’ve seen that take weeks.  Use the day calculator on the USCIS website to figure out the day your window opens and date/mail it on that date (90 days is not always 3 exact months).  Even if it’s a week or two later.  

 

Make sure you start planning 1-3 months in advance, because it’s a lot of printing and copying and assembling.
