The kids are american citizens... I'm the only one being petitioned for. I was also thinking if having a court wedding the first time she comes will be a red flag cause we love each other so much and we feel like we ready to make it official.

Her children will need to be included in the household size for the affidavit of support.  For many consulates, marrying on the first meeting can be a red flag.

But the kids are not mine..... shes only filling for me to come down to her, just me alone.

Does not matter.  They are members of her household, and therefore will be considered in the totality of her ability to financially sponsor an immigrant.

OK.    I should have known that from your first post .. old habit asking.    

 

Then for sure they are counted  = 5

 

Courthouse wedding no issue .. officially married and certified copies of marriage certificate are what matters.
