I really appreciate your response. As i said,she has three kids, she's a student and she has no bank account cause she closed her previous account,shes 30 and i am 28. What type of the visa would you advise we take, fiancé visa or we get married and she file for spouse visa? I'm new and never been into this before.

What does a bank account have to do with anything?

 

I suggest you read the guides listed at the top of the VJ home page.  They are pretty detailed.  Only you know the unique circumstances of your case and can determine whether fiancee vs spouse visa is best.

 

For both, she will need to be in a financial position to sponsor you as an immigrant. Immigration is very expensive.

My suggestion is the CR-1, reason being - the embassy has to accept a qualified co-sponsor.   

 

Whereas with the K-1 accepting a co-sponsor is at the embassy's discretion.

Thank you very much....what qualifies a co-sponsor to be accepted and are we gonna need a co-sponsor because she's not working but only a college student?

Qualification - adequate gross income to meet the I-864 requirements.
