Hi everyone,

 

I have 2 questions around the i-864 for sponsoring my husband:

1. My husband and I moved to Australia in 2010 from the US for my job (his green card has since expired and hence we're applying for another one) and my income is foreign (Aussie dollars) so  I know I cannot use my income from my job here in Australia. This is fine since we have enough US assets to cover the requirement.  But, what do  I put in part 6 of the i-864 (Sponsor's Employment and Income)? Do I just state that I have been 'unemployed' since the date that I left the US?

2. We file our taxes jointly and for 2018 our adjusted gross income is negative. Can I put a negative number into the Total Income field for the 2018 tax year? If so, I'll have to do it manually since you can't put a negative number when you fill the form in electronically but I wanted to find out if that was OK. I'm including our tax returns from 2017 and 2016 to show that this is not a normal year for us.

1. If sponsor is unemployed currently, than yes, it needs to be entered as unemployed.  Accuracy is the most important, even if he has been unemployed only for a day or two.

 

2. Handwrite in the negative number.  The PDF editors often have trouble with certain questions.  It's OK to type in the majority, and handwrite in black ink the other parts you couldn't.

Thanks! Now, I'm the sponsor and technically I'm not unemployed as I have a full-time job here in Australia but I know that my job doesn't count. I won't start my job in the US until a couple of months after we return to the US and it's too early to identify that now on the application. So,  that being said, the date the application requests needs to be in 2010 when I left my US job (I started my Australia job right when I arrived in Australia)?

You will have to print out the form and manually write in the negative number. 

 

Im also a little bit confused about your other question so I will give you this general advice. Fill out the form and answer the questions honestly and accurately. Do not say you are unemployed if you are employed in Australia. The form ask for employment history and info- no where does it say US employment only. They will not count your foreign income but it still needs to be disclosed.
