K1 Visa Extension - Manila Embassy

Timeline

Does anyone have any recent experience with asking for a K1 deadline extension.  Our deadline is June 25 and we're still waiting on some adoption paperwork that will extended beyond the 4 month deadline.  Our package is at the embassy now and we've completed but have not submitted the DS160 yet.  

 

Specifically - how to go about requesting an extension?  Do we call the consulate or set up an appointment in person.

Are you referring to the I-129F approval expiration? if so, Manila will extend it in 4 month increments for up to a year.

Also..adoption? Is this for a K-2 or something? Be very careful with adoption and immigration...most circumstances do not permit immigration benefits for an adopted child unless the biological parents have passed away and very limited other circumstances.

It should be automatic, but you can email USEM if you really want to confirm it.

She's had the child since he was 1 day old.  He's 14 now.  Both biological parents have been deceased for many years.  The issue is that the adoption paperwork isn't in order and the DSWD is trying to work through that which has been the case for over a year.  We thought it would be finished well before now.

Gotcha. I just wanted to be sure you verified eligibility for immigration benefits...many, many people assume just a legal adoption works. This is especially common from PH...lots of people want to adopt a family member to bring them to the US. Then they realize they are now the adopted parent of a child that they can't bring with them to the US, which sets up some very hard decisions to make.

 

It sounds like it shouldn't be an issue here, but I do suggest researching it just in case so there is no question (if you haven't done so already).

Thank you for the follow-up.  Yes we've researched it and we've used an attorney since the beginning to process the petition.  His position is that it's not a problem until it's a problem.  I don't really subscribe that philosophy.  I'd rather get ahead of the curve.  The immigration benefit itself is not an issue it's all a matter of paperwork.

It should be automatic, but you can email USEM if you really want to confirm it.

No need to request an extension,  the embassy automatically extends the petition for up to 1 year.
