Hi,

 

I am US citizen. I want to apply for my brother who is 35 now and married. He has a son of age 2. I would like to know how is the time period for him to get his case to become active from your experience. He is Indian. 7 year back, we applied visitor visa for him when he was unmarried. His visitor visa was refused twice. If I apply F4 visa now will this get in the way. 

 

I read when his case become active he can apply for his family and they all can come together. 

 

I really need some guidance.

15-20 years at current timelines, Congress could end the F4 category altogether as part of immigration reform, who knows. 

 

You did not apply for a visitor visa for him, neither did you sponsor him for a tourist visa. He applied, and was denied twice for lack of ties to India.

That is correct. He applied. If he applied visa now, do you think he has better chances to get it. He is been to Europe twice. He didn’t  reapply visa to US yet.

 

If i apply for F4 now and later on F4 is ended. Will his case be still considered or he will loose his chances to come here altogether.

No one knows how discontinued visa categories might be handled.

He is free to apply for a B2. No one anywhere could guess his chances.

It is possible the child will age out, difficult to say so far in the future, so your Brother is looking to retire in the US?

Or you can say, I am not planning to travel back when I am old.😊it will be comforting to have family here.

Possibly not so comforting for your family who will have lived a whole life elsewhere and then not only leave everything they know and have built up, but also have to figure out how to fund an expensive retirement in the US after not earning hard currency.  It will take them 10 years of working in the US to build up social security /Medicare etc, maybe not so appealing if you are already 55-60 when you move.

Nevertheless that’s a decision that’s a quarter century or so away, plenty of time for everyone to figure out the pros and cons.

Assuming family gets immigrant visas; no guarantees. Moving back to India is something some with a generous nest egg consider, esp if being close to family is important.
