Visa overstay

About visa overstay, one thing that the gobernement can do it is stop adjustment status for overstay.

It is insane that all who immigate to usa legaly, wait long time in our home country to come here , and many people just flight to usa, overstay and adjustatus living here.

If uscis stop adjustment status many of them go back to their country.

Another thing, they overstay is because they can work very easy without authorization.

They work and adjust status easy while living here.

Many of us arrive in k1 visa and we cant work until get work permit and adjust statust is a long waiting sometimes.

Those who arrive on tourist visas cannot legally work in the US without authorization, either.

Thing is, they may go back to their home country and they may not.  Not being able to AOS doesn't stop millions of people (who arrive on all sorts of visas---work, student, K1's who enter and then don't marry, etc.) from staying illegally for years or even decades after their visa/duration of stay expires.

 

I'm pretty sure AOS from tourist visas is probably under the radar when it comes to any immigration reform in the works, though.

I actually think that it's very under the radar currently, as are visa overstays in general...I get the impression that there is a lot of pressure put on Embassies and Consulates to not issue visas to potential overstayers, so USCIS/DOS/DHS sort of farms out that gatekeeping to them and then well, if someone does get the visa and decides to overstay, they just fall off the grid and become nearly undetectable as USCIS and ICE already have tons of other work to do, seems like it would be very low priority for them to go after (unfortunately). And in the case of tourist visas or other non-immigrant visas, it wouldn't even be USCIS but DHS who would handle that. Some stats here on overstays:

Then there's the question of, if they did want to priotiize, how? Easier said than done I'm afraid...similar to the discussion going on in the other thread:
