Can I open sealed envelope after entry to the US?

Hi all - 

 

I lately completed the first step of my K-1 Visa application and entered the United States without the CBP asking me for the sealed envelope that had all visa documents. 

 

Throughout the process of filling I-485, I was asked to add my long form birth certificate in the required documents, and the only way that I can add it is by taking it from the visa documents that are in the sealed envelope. 

 

Should I go ahead and open it ? I thought that I could as I am already in the US and passed the process of CBP. 

 

I would appreciate your insight !

I wouldn't, I would contact someone about handing the packet over to proper personnel as they should have taken it.

 

It is important to have multiple copies of everything as when they are submitted, you don't get them back.

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

I agree with @Ben&Zian, I would maybe take it to your local USCIS office, or just keep it until the GC interview comes around.  I have been hearing that these packets are being converted to electronic documents, so this may be why CBP didn’t ask for it, but why risk it.

Since the contents of the envelope constitutes her "A" file, I am fairly certain there is no possibility of an I-485 approval let alone a GC interview if they don't have it.

 

I think the "E" packet is being rolled out for immigrant visas.  Haven't heard it has rolled to K-1s yet.

 

I am more curious as to what her admission status is on her I94

 

What is your home country?

Mmm oops. I wouldn’t open it. 

 

What  about taking it to the nearest CBP Deferred Inspection Site.  I know they correct other entry errors such as incorrect stamps on the passport, I94 data etc 

May be easier to get into than a USCIS office 

 

If the USCIS can’t locate the original document package they will not be able to process the AOS. We’ve seen this when e packets have been used for IR immigrants, but the manufacture of the GC has halted because the system is wrongly looking for a physical package. 

 

on the matter of birth certificates.. it’s always  wise to have multiple originals on hand as they often have to be sent. Best to get a couple more on hand now

There was a case not long ago that the beneficiary stated that she didn't receive a envelope from USEM and she traveled through immigration which had a copy of her file and said they didn't need it. BUT, that not to say that it is different for other countries.

 

It's best to either set up a InforPass meeting at the nearest USCIS office or if you have immigration at your airport, it would be my choice to go there.

Epacket is bring rolled out.  The person you were referring to was an IR if I remember.    In this case she received the packet, which by default indicates not on the epacket program.

What is your home country?  

My admission status is K-1 visa and I am from Morocco. 

 

I just called USCIS who told me that I need to bring the sealed envelope to their office, so I guess that there was a mistake - I will let you know what they tell me.
