I've a question for you. This applies to me as well, however I'm in Thailand. Might I ask you what you listed as your Country of Domicile? I am ready to submit our Packet 3 but that section on the I-864 is holding me up as I don't know whether to list it as Thailand or the USA. My mailing address is in the USA, my residence address for DCF is Thailand, but I'm unsure as which country to use as the Country of Domicile. In the states, I still have a valid driver's license (renewed 2 months ago), car registration, car and health insurance, a bank account, credit union, investment accounts. I do not own real estate or have a lease. Any suggestions or thoughts?

I lived in the Philippines for two years. I used my address here in the Philippines. When it asked for which address in the USA will my wife and I go to, I stated my old address or my parents address. When asked by the officer about establishing domicile in the USA I informed them I will be staying on my parents property until we are able to get out on our own. The officer asked me why I wanted to go back to the USA and not stay in the Philippines (that question surprised me being the petitioner). We used the physical address we were living and for mailing address we used my wife's parents home because it was easier to get the mail there. 

 

To have your question about domicile answer better, perhaps calling the embassy would be the best option for clarity.

I have asked the Consulate but their response is that they can't offer legal advice... it is obviously a standard prompt, and is the one I've gotten on two other occasions when I have asked for advice. I do maintain an official mailing address in Hawaii for all my financial needs (income tax statements, bank account, credit union, investment account, credit cards), however with that said I live in Thailand for 3/4 of the year and used that as my residence. Because of that, I think I should use Thailand as my Country of Domicile. My confusion lies within whether or not to claim the U.S. as my Country of Domicile or Thailand, knowing full well that you can not sponsor someone if your Country of Domicile is not the USA. Fortunately, I guess I can claim intent while providing proof of everything above.

That should be more than enough if it is similar to the Philippines. That is pretty much what I gave them as well. I would think they won't allow you to file DCF if you claim the USA as your country of domicile.
