I'm in the process of filing the i130 for my wife and child. Currently I'm unemployed and concerned about the next step when i have to show my finances. Assuming the i130 is approved can i move back to the usa and get a job to satisfy the income requirements? Or do i have to stay in mexico until my wife gets her green card?  My current assets are $54,000 401k $50,000 in stocks and $20,000 cash reserve but i don't want to depend on that.

You, the petitioner,  can move back to the US after the I130 is filed.   I would file it in person so you know everything is good and you would get a confirmation back.  We got ours the next business day.

Thanks and i ment "petitioner" not "beneficiary" I hope that didn't cause too much confusion.

You - the USC or LPR -  are the petitioner, not beneficiary. You can come to the US fine.

 

Once you file the I-130 abroad, you can return to the US. No need to even wait for it to be approved - just properly filed.

I worded my answer with the assumption you were the USC. :)

 

USCIS is closing the field offices.  The Mexico offices are closing this summer.  https://www.uscis.gov/about-us/find-uscis-office/international-immigration-offices

 

I would urge you to get the petitions filed very soon.  If there is anyway to do it in person I would recommend it.  

 

We are able to get ours done from filing in late June last year to having my wife in the US the first week of October.

Thanks Paul, I heard about the field offices closing but didn't realize it was so soon, you have anymore information about the date? . You think if we get the i130 filed and approved we would be able to complete the process in mexico after the office closes or would it be transferred to the usa? 

 

The Juarez field office says no walkins did you schedule an appointment first?

You go online to USCIS field office site and make an InfoPASS appointment.   Make sure that is the correct field office as each has its own states served.   The initial processing is done right in front of you and they will make sure everything is there.   It is then reviewed by a supervisor and sits in a pile to be walked over to the Department of State Unit.   We got our USCIS written approval the next business day.  It took 6 weeks to get the Interview date.  It was set for December 27th but I checked online daily and got moved up September 25th.

 

I think the closing date talked about on this site is June 30th.   But they closed Cuba sooner then planned and stopped accepting in Moscow at the end of February.

Nothing is official about the offices closing. It's widely reported and expected, but there's no official word at this time.

Latest reports are that they plan to close one in Mexico in late June, followed by Manila days later. Several more will follow in the coming months, with the last being in early 2020.

 

Adjudication of the I-130 for DCF typically takes on the scale of weeks. Sometimes less. I wouldn't be too worried about them not adjudicating it before closing so long as you file soon.

Do you know if cuba and russia are still processing the petitions that were sent before the closing date?

Someone posted yesterday about Moscow.   They turned in before it closed and is processing on the Department of State side.   

 

The application literally stays with USCIS a day or two, and then is walked over to Department of State Immigrant Visa Unit.  Once you get the email it is out of USCIS hands.   Your payment receipt is the NOA1 and the email is the NOA2.  You get to skip the whole NVC process.

 

If you are worried about not being ready you can still apply for DCF under exceptional circumstances which does include you, the USC, needing to get back to a job in the US,

Depending on which Mexico USCIS Field Office you are required to file your Form I-130 petition, most assuredly check as to whether you need to make an appointment to go that office to submit it in person, as opposed to mailing it.  There are only three USCIS Field Offices in Mexico where you can file a DCF I-130 petition, each office handling specific geographical Mexican states.  Be certain check which office will accept the filing of your petition.  Buen suerte
