Hello! My conditional permanent residency will expire on 8/1/2019 and I’m supposed to file it within the 90 day period. Would it be okay if I sent it Friday? It might not make it there on the day of, maybe a couple days later... is that okay? I’m sorry if this is a dumb question. Thank you in advance.

Absolutely do not send it early please.  Go to the Post office May 1st.  Very important to not file early.

If it is received even one day prior to the 90 days it will be returned , do play it safe and leave signing, dating and mailing it until at least the day the 90 day window opens .. my calculation says the 90 day period starts on May  3rd

so so you should be fine to sign date and have it postmarked May 3rd , but not before

90 days is not necessarily 3 calendar months. USCIS has a calendar on its webpage to assist with calculating early filing dates

https://www.uscis.gov/forms/uscis-early-filing-calculator

this link is attached to the N400 form but has the same 90 day early filing condition

You are quite right

Posted (edited)

As long as it arrives on or after the first day of your filing period, it should be fine. But is it really worth it to risk it arriving even 1 day early? You have 90 days...I highly suggest NOT aiming for the 1st day possible.

And as stated, make sure you count 90 days, not 3 months.

Thank you! Maybe I was getting mixed up and over analyzed. I thought it would mean I have to send it out so it will get there ON May 3rd....

So sending it out on May 3rd is best? What if I send it and it isn’t within 90 days? Like 85 days... I’m adding in scenario in case I am a few days late

thank you again

Within 90 day window .. so it can arrive any time from the 90 days before until ..... just not before 90 days , and not necessarily ON the 90th day

Sorry just a fellow K-1er here, I am a little confused what is the document "it" you all are talking about, the document that you have to be within the 90 day window of your conditional green card expiring if I am understanding this all properly.

"it" = the I-751. See the thread's title.

If married for under 2 years at the time AOS is approved, you will get a conditional (2 year) green card. These conditions must be removed, and this is done via filing an I-751. This entails showing that the marriage is bona fide (or that it was entered into in good faith).

The I-751 must be filed within the 90 day period of the 2 year anniversary of obtaining the green card. Limited exceptions apply to file early.

Upon approval of the I-751, you get a 10 year green card, which can be renewed indefinitely via an I-90 .

ohhh okay, and when you have the 10 year green card after a set amount of time is when you can then proceed with the N-400 with naturalization correct?

Thanks in advance, was curious.

You can file the N-400 once you are eligible. This includes if you have an I-751 still pending (but you can't skip the I-751!).

If married to a USC for 3+ years while also having a green card for 3+ years, you can file under the 3 year rule. Otherwise, you can file under the 5 year rule. There is a 90 day early filing period (meaning you can file 90 days before being eligible, or any point afterwards).

what's the 5 year rule?
