I am getting ready to send off my AOS for my wife and am a bit confused on some parts of the affidavit of support. Up until this month, I was employed and making enough money to be the sole sponsor. However, I just lost my job and my father will now be my joint sponsor. 

 

First, for part 5 on household sponsor's size. It will be me, my wife, and my parents. Is the household size 3 or 4? 

 

On part 5 item 7 Optional, do I put a ? it asks about if you have someone combining their income by submitting i-864a, enter the nuimber here. Am I supposed to put 1? My father makes enough money to cosponsor alone. Do I need to fill out an i-864a with my mother's income as well? If so, what do I put in the box? a 1 for my father or 2 for both of them?

 

Last question, when it asks about my income, what do I Put? I am not currently employed full time, but this year I have earned close to 20,000 dollars. How do I fill this out? do I still include last pay stubs from this year or do I just give my tax transcripts for the 2018 year. I DO have contractual work right now, but I make below the poverty line because its inconsistent and hard to prove. How do I fill this out?

Does your father live at the same address as you ? Does he claim you as a dependant on his tax or are you living independently in the same house ?

I’ll look for others to confirm but my thoughts are 

1. you are the principal sponsor so must complete your I 864

2. Household number for your form is 2 

3. Part 5 #7   You are not combining income with another household member. You will be using a joint sponsor 

4. Current income .. put your estimated full year income as at the date of signing the form.  Use payslips and bank deposits as evidence. But your current income level is not an issue as you are using a joint sponsor 

5. your father completes his own I864. His household number will be him + his wife + number of dependants if any + immigrant 

6. His wife can complete the I864a if desired, but if his income alone .., as evidenced by his W2, payslips etc is sufficient, it is not required . Some people do it just to cover all bases 

7.  If things change for you before your wife’s interview , and you have a new regular job which gets you above the 125% line, complete a new I864 to show this and send it to your wife along with the new payslips etc . The interviewing  Officer will make a decision then
