Hello All... it's me again back at it worrying about the same issue..

 

I'm trying to keep my head up and see the positive in all of this but it still lingers and causes me much stress and anxiety. So my reason for creating this post today is I'm wondering about your opinion if I'm going to need a waiver (I-601) for the following issue:

 

I had been sent to secondary and received an I-275 8 years ago (December 2, 2011- My car was searched and they found a small leaf that tested positive for marijuana (yes very stupid I know, I did not realize it was in my car...seriously huge lapse in judgement...the biggest mistake I have ever made and also learned a lot from). The border officers had me sign form I-275 Withdrawal of Application for Admission, recently I got a copy of the documentation from FOIA.. it also states I had admitted to smoking marijuana 3 hours prior to attempting to enter the states.. I was young and very stupid and very naive to the rules/regulations of the United States. I look back now and realize that I could have really screwed up my future because I didn't use my head when I was younger. After that issue I have never touched marijuana again.. honestly I was so scared of that situation it really deterred me from ever wanting to touch it again. I am now almost 31 years old, no criminal convictions, and a hardworking Accountant (just to give you some insight on who I am as a person)

 

Prior to attempting admittance in 2018 I had done my due diligence in the beginning of 2018 and went to the same Port of Entry (Peace Bridge) to confirm if I am still inadmissable to the United States and the border officer I was speaking with asked me a couple of questions and then told me that it has been a long time since I have tried to re-enter and that I was now Admissable. Since then I have gone to New York every other weekend with no issues at all.

 

So I would gladly appreciate if any of you amazingly knowledgeable people are able to tell me if I'm going to need a waiver? Are there waivers for this sort of thing? The reason I ask is because upon receiving packet 3 there was a note on the copy of the I-129F that read "bene has inadmissibility issue." Upon reading that I immediately got very sad and disheartened that this will be the end of my journey to spend my life with my fiance.

Have you attended your interview? If not, once you do, you will get your answer there. If they are questioning the inadminsibility for the marijuana, yes you can file the 601 waiver, from what understand. Hope this helps.

Hi thank you so much for your reply. I looked over the 601 waiver and it only covers a single offense of marijuana possession under 30 grams (my interpretation of that is that you must have a criminal offense). I do not have a conviction or any criminal charge relating to marijuana as I had never touched it again after that day. That is the part that confuses me 😥

 

But alas you are correct the only way to tell is when I have my interview which is coming up on May 22nd. I do hope this isn't as big of an issue as I'm making it out to be.
