Hi All,

I can't seem to find the phone number to the visa office so i can ask them directly.  But anyway, so let's say my fiance visa is granted then we will go to the court to  apply marriage certificate.  After done with marriage certificate, we would like to have wedding ceremony.  Does the wedding ceremony location have to be in my Washington state?  Can I have wedding ceremony in my fiance country because she has a lot of relatives over there and too expensive for them to buy flight tickets to  attend the weeding if we celebrate in Washington?

After entering the US on a K-1, UNMARRIED, get married anywhere in the US legally, then apply for AOS/EAD/AP, wait a few months, around 6 months for AP, before the K-1 recipient can leave the country to return home for a wedding reception/celebration with fiance's family in attendance.

thank you for this important information..

So after waiting roughly for 6-9 months to get K-1 approved, I have to wait for another 6 months before I can apply AP.   That is a long wait.

You apply for AP at the same time you file for Adjustment of Status (after marriage).  You file the I-485, I-765, and I-131 all at the same time....then about 4-6 months later after filing, you can expect to receive your Advance Parole document.

OP you should take a look at the guide on this forum for applying for Adjustment of Status, with an EAD and AP.  https://www.visajourney.com/content/k1k3aos

If you want your spouse to remain in the US legally after marriage, Adjustment of Status must be filed. If you want your spouse to have the ability to work and travel an EAD and AP must be filed for at the same time. The fees for those two will be waived if you file for and pay the fees required for AOS.

If you are only just now finding this out, that it takes 6-9 months for a K-1 visa, then another 6 months for AP/EAD to travel outside the US or work, and if you have just applied for a K-1, I would suggest that you think about cancelling the petition, get married now in your fiancee's country and immediately after apply for a CR-1 spousal visa--this way the wedding could be with your fiancee's family in attendance, who cannot travel to the US, and your fiancee can travel and work immediately after entering the US on the CR-1 visa as an LPR.  Something to think about anyway and the CR-1 takes about a year.

Yep, that's good suggestion.

After you get married and receive the marriage certificate (can take up to 30 days to receive), you can apply for AOS, EAD/AP.  Expect 4-6 months for the EAD/AP to be processed and mailed.  The processing times are estimates, and can change at any time.   Until she receives the card, your spouse cannot work, and if she departs the US she cannot come back.

You may be better off not planning something overseas with dates/flights involved, as she may not have her AP in time.

thank you everyone for replying.

Sorry I used the wrong word or understood it incorrectly.

When I said wedding ceremony, i meant the wedding reception (party to celebrate this special occasion).

I will apply K-1 for my girlfriend.  After the K-1 visa is granted, she will fly to my home state and we will go to court to register marriage.

After marriage certificate is completed, we will celebrate with families, relatives and friends.  So for this celebration, we can have it anywhere right?

She can't leave the country unless she has an issued Advance Parole in her hands before leaving. Otherwise she is not allowed back and you need to file for CR1 visa.

Basically the timeline would be

0. Get SS number for her before getting married.

1. Get married

2. Wait for the marriage license

3. File for Adjustment of status(AOS) and work permit( EAD) and advance parole (AP)

The EAD/AP will take around 6 months right now, who knows, it might be less or more when u file. So plan accordingly.

2. Wait for marriage certificate. Some states will have to affirm the same license paper as a marriage certificate so make you are sending the right document.

Once she is here,  she cannot leave the US until she gets the advanced parole which can be included in your AOS

Hi there! That's what my fiance and I plan to do. Once I cross into the United States we are getting married there then once I get my AP, etc approved we plan to have a reception with all of our family and friends back in my home country (Canada). Since it is cheaper for everyone! :)
