Hello,

I’m trying to get my Japanese spouse a green card. I’m currently living in Japan and my income here is very low but my total assets are around $80k (held in a US brokerage account, assets mainly stocks). 

My question is regarding the Affidavit of Support form I-864. Can someone confirm that this is correct?

I have to fill out the form i-864 and select 1.a. ‘I Am The Petitioner’.

Because my income is under 125% of the poverty line, do I need another sponsor or do my assets count and put me over the threshold?

you can use assets if you have enough to cover the difference in what is made, however only US income will be considered I believe.

 

Example of How to Use Assets: If you are petitioning for a parent and the poverty line for your household size is $22,062 and your current income is $18,062, the difference between your current income and the poverty line is $4,000. In order for assets to help you qualify, the combination of your assets, plus the assets of any household member who is signing Form I-864A, plus any available assets of the sponsored immigrant, would have to equal five times this difference (5 x $4,000). In this case, you would meet the income requirements if the net value of the assets equaled at least $20,000

 

you need to make sure you have filed USA taxes each year.

 

If you do not meet the guidelines to assets and the income is still below you will need a sponsor.

That's correct but for a spouse you only need 3 X the income shortfall.  When you say your "income here" do you mean in the US, or in another country.  If not in the US, or will not continue from the same source in the US, you enter $0 as your "current income you are using to qualify...." and your shortfall is the entire income requirement.

 

Become an A student of those I-864 instructions, NOW!

I meant to say my income here in Japan is very low. My income in the US is zero at the moment. 

3x the Federal poverty guidelines @ 125% is $79,989, which is about what my assets total these days.

 

Now does it matter that my spouse who i’m trying to get this immigrant visa for has more than 100k?

Use the figures from the I-864p for your household size, using the 125% figure.  Multiply that number by 3, and that would be the minimum in liquid assets you would need.  Your number doesn't fit any of the numbers there.  For a household of 2, the number is 21,137  X 3  = 63,411.

 

Bear in mind that just meeting the minimum is no assurance of approval.  It's a judgment call.  Probably would be wise to come home and get a job or find a qualified joint sponsor.  I see you have not yet become an A student of the I-864 instructions. Doing so, is going to be critical to your ultimate success.

Thank you for the advice. Today’s work is learning the instructions and reading all the FAQ regarding this part of the process. Much appreciated.
