Just wondering if anyone can give a little guidance.

My wife came in on a K-1 visa and two weeks after her arrival we applied for a SS card at the local office. We were told that it would take up to 4 weeks. We married at 5 weeks and still had not received her SS card. The following day we went down to the local office and gave them the reference number and for some reason they were not able to retrieve the information. So they said we had to re-apply but now that we were married no one at that office knew what to do. I can hear the representative mumble to another employee that the form was being declined by homeland security and they couldnt understand why. We left there being told to wait another 4 weeks but we are getting close to the visa expiration date and I still need to submit the I-485 form.  We left pretty helpless and unsure what to do next. I have two questions: 1. Do we need a SS card to submit the I-485( I know the form asks to input if one has it)  2. What do we do about obtaining a SS card?

You cant apply in your married name. That is the error. When you went back you should have reapplied in her maiden name even if you were married. You will likely not get one now as SAA can only issue SSNs to immigrants in the name that matches the name DHS has on file which is the maiden name.

1. No. But you can now request one to be sent to you by filling out the I765 accordingly. Once your EAD is approved in 5 to 7 months your new SSN will be mailed out shortly after in her new married name (ie apply for I485, I765 and I131 in the married name).

2. As above. SSA will be of no further help until you receive either an EAD or GC.

Thank you for the response. The associate was kind enough to try her maiden name and still no luck. She has not changed her last name so Im a bit confused on how we apply in married name

She has a name mismatch then and is in manual verification. As long as the associate did not apply in the married name you may still get it after they clear up the name mismatch with DHS provided you still have 14 days left on your I94.

 

As an immigrant, the first place you can change your name after marriage IS on the AOS application by applying in her married name. You simply provide photocopies of the MC with each form. Immigrants are not like Americans who can change it immediately.

 

The process for an immigrant name change occurs when the EAD or GC is approved (which ever comes first). So all immigrants who change their name will never have official government ID until after the first immigration benefit is issued. For an EAD/AP that will be 5 to 7 months currently. For a GC that will be a few months to a couple of years depending on the processing times of your local field office. 

 

This is the normal process for an immigrant name change. None of us will have ID until much later.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You don't need SS for AoS. Don't wait, submit it. On form I-765 that you will submit with AoS request SS card there.
