You need the  I130, I130A, I131, I485, I765 and I864.  File with a G-1145 for text / email notice and G-1450 for a Credit Card.  8 passport photos and he needs to either file the last 3 years of tax returns or a letter explaining it isn't needed.

Your joint sponsor needs to file the I864 and I864A if the spouse of the joint sponsor if married.  Tax transcripts for the joint sponsors.   Do it now rather than latter.   Things change, circumstances change, laws change.

One quick question does it matter who the sponsor is ? Can it be anyone?

No just needs to cover their household plus the beneficiary.  Look at I-864P

I could be deported in 2 months?

Somebody is extremely unlikely to actually be deported in 2 months.

While still pretty unlikely, getting a Notice To Appear (NTA) in that time is much more likely than actually being deported. Once an NTA is issued, you can no longer file for AOS with USCIS - you would need to have an immigration judge address your case first. That process would entail a lot of unnecessary time, stress, and additional costs.

We didn't want to borrow money as my husband was paying off his loan , we had no intention of not filing ever , we were just saving .

In that time with even just 15 hours of work per week, 50 weeks annually, at the federal minimum wage you could have earned a few times the amount needed to pay back the filing fees.

It is what it is now....no way to go back in time.

What would I needed to have done to get a NTA? I haven't worked or done anything illegal apart from overstay my visa

Run into the wrong person?

For example, immigration enforcement officials have stopped public transit to check the paperwork of anybody onboard.

I'm not suggesting it's likely in any way (there's millions of people in similar situations), but unlawful presence alone is sufficient cause for an NTA and removal. The question is just if/when somebody gets caught, or if they obtain a legal status/authorized stay before that happens.

You just need to be in the wrong place at the wrong time.  You don't want to get a NTA before AOS.   You file the AOS then you are here legally while it is being adjudicated.

Borrow some money, use credit cards, (sell plasma ;) ) .  You will feel better at night.

If you live in one of the Southern Border states there are inland CBP/ICE checkpoints, CBP officers sometimes hang out at TSA checkpoints.  Again, highly unlikely you will run into an ICE or CBP officer, but it is possible.

I get stopped at these checkpoints at least once a month. They seem to be set up 50-100 miles from the southern border. I have been stopped on big freeways and small back roads, even a bike path..  well not quite, but almost. It's too the point I carry my passport with me now, makes things easier. I have definitely been stopped the most in Arizona by far, a few times in Texas, and once in California near Arizona border. Just a minor inconvenience I guess, though a little excessive I think. I keep asking for a pass for my windshield or something, but who knows.

Here on a K1? Need married and a Certificate in hand within a few hours? I'm here to help. Come to Vegas and I'll marry you Vegas style!!   Visa Journey members are always FREE for my services. I know the costs involved in this whole game of immigration, and if I can save you some money I will!

The 100 mile zone.  Michigan could be full of them theoretically, but we have not seen them yet.  I did run into one a few years ago about 30 miles North of Yuma on US95.
