DCF London - Affidavit of Support

Hi,

We have recevied the NOA 2 and I now need to complete the DS-260 online.

 

My wife and I live in the UK with our 3 children, I'm the only one without a US passport. My wife is stay at home mum with zero income for the last 5 years, so her Aunt has agreed to sponsor me.

 

Does my wife need to complete an I-864 and enter her aunt as the sponsor and also aunt needs to complete a I-864 too?

 

Aunt is in the US so planning to email her the form to complete (or send link), and then she would return back to us via mail?

Should also add that my wife has not filed any tax returns for the last 5 years as per above, she has earned zero income. Is there a requirement she still files a return?

Your wife has to do an I-864 even if she puts unemployed and zero for her current income. The aunt will do her own I -864 and provide at minimum 2018 tax transcript, proof of her US citizenship, an any optional proof of income like  pay stubs, or employer letter. If the aunt is married and filed a joint return with her spouse, then there's a little more to do. Is she single or married?

 

I will add before you ask, the aunt does not have to support the Americans in your family. Her household count is her family plus you.

No. No income then no tax return, but per the instructions to form I-864 she needs to provide a signed statement in lieu of tax returns saying she did not file returns for [year, year, year] because she was unemployed and earned $0.00 dollars in each of those years.

Aunt is single. 

On the I864 it asks for sponsors name. When we complete my wife's do we enter her or her aunt as the sponsor? Think it is page 5 on the I-894

Your wife answers for herself. She is the primary sponsor. She makes no mention of aunt. In first section wife is 1a The petitioner.

 

The aunt answers for herself. She is the sponsor on her form. In the first section aunt is 1d. Only joint sponsor.

 

See a little edit I did in my first post about  aunt's household size.

Yes I see that. Aunts income is sufficient to cover her children and me based on 125% of the poverty line.

One more thing. Go read the I-864 instructions about Domicile. It starts on page 5 with--

Item Number 5. Country of Domicile. Indicate the country where you maintain your principal residence and where you plan to reside for the foreseeable future. If your mailing address and/or place of residence is not in the United States, but your country of domicile is the United States, you must attach a typed or printed explanation and documentary evidence indicating how you meet the domicile requirement. If you are not currently living in the United States, you may meet the domicile requirement if you can submit evidence to establish that any of the following conditions apply:
