I am planning to apply for expedited processing for my AP an all that comes with it after entering the US, but of course I know that there is no guarantee it will be approved.

 

Has anyone here had an expedited request approved that was not related to one of the reasons on USCIS' criteria?

 

 

 

Expediting AP? You can't expedite administrative processing. And you can't pre-expedite request anything to do with AOS.  

 

AP is open ended and can last 2-3 days, 2-3 weeks, 2-3 months, even 1-2+ years. It's only when the embassy makes a decision does AP end, either in approval or denial. USCIS has nothing to do with AP anyways.

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

~Moved to Adjustment of Status Case Filing And Progress Reports~

 

You can definitely try to expedite for the AP/EAD, doesn't hurt to try. Generally AP/EAD combo is expedited based on job offer being given. 

 

As to the I-485 itself, don't think that can be expedited unless maybe in some extreme circumstances, but even then as long as you have AP you technically aren't "stuck" so.

I believe the request must meet one of the listed criteria......

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

A job offer is exactly the reason, just not for me... I will be "stuck" in the US and my future spouse will be in Canada (he has already started working there this month).

and yes you're right, all I need is the AP really, even the EAD will be useless anyway in another country.

I will definitely try to expedite, just wondering if anyone here had any positive experience with it outside the normal criteria 🤔

Why are you not moving to Canada, does not make much sense to move to the US.

Sounds like it will fall into one of those issues with the K1 category, even of you could get an expedite it just means quicker rather than quick.

If you're still in the K-1 process you can wait from any country, Canada included.  A bigger issue at your K-1 interview will be the petitioner's US domicile and US income.

That is not the issue at the moment, I am doing my interview in a different country and then going to Canada in order to not be "stuck" in the US after entering with the K1 which is a single entry visa.

Can you please explain in more detail what is going on or what you are trying to do? It seems like you are saying you are currently from and in a 3rd country- lets say France. Your fiance is a USC and is temp living/working in Canada and you are going to go to the interview in France, get the K visa and then travel to Canada. Then from Canada enter the US with your K visa and apply for an expedite for the AP to be able to go back to Canada to live with your spouse while hes working there. Is that correct? Putting aside the domicile and income stuff- the expedite criteria is non negotiable and strictly abided by to the letter. There is no wiggle room, You either meet the criteria that is listed or you do not. Being 'apart' from your spouse is not considered a hardship. Perhaps you can try to claim financial reasons of not being able to support 2 households but the K visa and subsequent AOS is for you to be able to live in the US with your spouse- so its hard to argue you need AP travel privileges to be able to travel to another country to be with your spouse and live in a household there- does that make sense? How temp is the work in Canada? Can you just delay the interview and visa issuance until its over and travel to Canada on your current passport until then?

The K1 process is not designed to give you the results you are asking for.   BF applies in US, you live in France, both of you move to Canada and he works in Canada beofre and after you are married.  

 

You "generally" need to have the legal residency to live in a country to have the K1 interview there.

 

No one wants to be apart during the process.  But your fiance will need legal domicile in the US prior to your interview.

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
