You can't leave the U.S. while AOS is pending unless you have AP approval. Can you give additional details? What do you mean by "continue it?"

Well after I typed it,,,I realized he is CR1 ! So he would need AP right?

K3s are multiple entry. AP is not required.

If you don't show up for the interview, they will deny the application. Someone mentioned that it takes a long time to actually reschedule an interview ahead of time.

If he's a CR1 he already has his greencard , so he doesn't need AP and there wouldn't be an interview.

Personally I'd return home for the interview. He needs to be watching how much time he spends out of the country anyway, unless he wants to accidentally abandon his adjustment.

HI everyone, sorry for the confusement. My husband is here on the K3 and it's multi-entry. He arrived on August 24, 2006 and wants to travel home in October of 2007 for a month and a half which I really dont' agree on, but he says time goes by so fast, and he wants to see his Mom and sisters and brothers, etc. Maybe he's homesick, who knows. He seems very content here though. Anyway, following the processing times in Chicago, they are on receipts received as of October, 2006.

Im guessing that his interview would be around October/November if they stay on time as they have been. Right now, the AOS is pending for additional income proof from the co sponsor which will be in shortly and mailed off to them. I know the K3 is multi entry, so not worried about that, but what if we get notice of interview and he's not here. As I am seeing answers here, it wouldn't be a good idea to continue the interview until he arrives back. I'm just asking for some suggestions here, like how far in advance do they let you know when the interview for AOS will be, etc. And will they question him regarding how long he's been out of the country on a K3 and a pending AOS.

He should be here during his Interview and Biometric because he is the applicant and not you. In my interview notice says, failure to appear the schedule may results denial of the application.

ah ok. Based on my experience I got my notice of Interview 43 days before the schedule.And I think and I hope you'll have your interview before your husband will travel.

I know it may sound silly but...can't he just he just buy an open ticket so he can change the return date in case you guys have the interview while he is supposed to be with the family?
