I-134 / Philippine Embassy

I just got the email last night stating that my fiancé can now schedule an appointment .. my only concerns are as follows :

-  I am filing I-134, last 3 years of W2,  and income tax returns

1. I am Active duty US Armed forces..so I am under the impression that I do not need to provide bank statements/assets/life insurance etc because I meet the income requirement?

2. If my fiancé gets her visa interview schedule next month, how would I know if the affidavit of support is good to go when they check for it (US embassy Manila) at the day of her interview?

I want to do this the right way for the first time.  i highly appreciate your input.

1) true for everyone not just active military

2) Won't know until day of interview and only if they issue a 221g for public charge

YMMV

you dont actually file this, you fill in the form sign it, attached the necessary supporting documents (ie. tax transcript, tax return, w2s) and send to her via courier or just scan everything and send her by email.

this is for everyone not only for active us army, the only difference is the income requirement which is 100% of the poverty guidelines instead of 125%

if you are confident that your income is enough for the CO to not consider her likely to become as public charge, then tax returns docs will be enough as supporting documents for your i134

yes active us army income requirement in 100% of the poverty guideline and if your income is way higher than that which  $16,910 for household of 2 then you have nothing to worry about, just my opinion. goodluck

Largely country-specific thread is moved form the K-1 Process forum to the Philippines regional forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

For the I-134 the embassy only wants your MOST recent tax return and W2 (1099)  .. not 3 years .... not bank statements, not assets.   Embassy will not even consider assets so don't both with all that useless paperwork.   And the embassy will not take additional years of tax returns.

You can email the I-134 and tax return info to your fiancee.    Being you are military you need only meet the 100% income.

I don't know of any time that the embassy in Manila has asked for bank statements (unless a person is using interest income).

Here is a link to the 5 steps for embassy requirements.  Step 5 is the documents checklist.

No.   The embassy only looks at "now" they don't try to speculate on the future.

I’m divorced.. I’m paying child support however, his mother claims him on her yearly tax.

do I need to include him as “partially support him” as a dependent?
