marriage cert a must even if divorced? - help urgently needed

Recommended Posts

Marriage certificate from previous marriage? No. 

 

Marriage certificate for current marriage? Yes.

Thanks coz I just got confused with the list in packet 3 which is -

"MARRIAGE CERTIFICATES:Both the petitioner and applicant must present legal marriage certificates for all PRIOR and current marriages 

TERMINATION OF PREVIOUS MARRIAGES:If either the petitioner or applicant was previously married, they must provide proof of termination of that marriage (e.g. death certificate of spouse, final divorce decree or annulment)."

I mean we didn't provide marriage certificate for my husbands previous marriage and we were fine. 

 

Not sure if this is different for all countries though?

I feel your pain. I don't know the answer to your question, but if you are doing the consular processing in Bangkok, you saw the directions as posted above. It seems ridiculous that anyone should have to provide marriage and divorce certificates (or proof) beyond their previous or current marriage. I am being cautious and have ordered a marriage cert from 1976, and the divorce judgement from 1978 for that marriage. It is a pain in the ### and has added months to my application process. I am also including the marriage cert from 1984 and divorce judgement from 2012 for that marriage. Since the directions say "all prior" marriages, I feel that pretty much sums it up since "all" means "all". My opinion (as it pertains to me, or anyone else)  as to whether or not you need to submit the paperwork is that you need too. I had no paperwork from my first marriage, and had to order a copy of the marriage certificate from one state, and get the divorce judgement from another (which was compounded by the fact they couldn't find it). 

I think for this process, it is better safe than sorry. In my case, I didn't want the opportunity for the consulate to kick my application back to me, so for me, I'm providing it. I will say that I have had friends who have gotten green cards for their wives and didn't list ALL prior marriages on their application, only the last one, and they sailed through. Me, I'm going by the book, they want it, I'll provide it, lol. This is too important for me to mess up. Good luck with whatever you do!

I was wondering the same thing. A new question on the immigration visa application is date of previous wedding and date of birth of the ex spouse for the beneficiary, I haven't seen the whole form yet but we were a little surprised at those new questions.

You only need the divorce cert for the old marriage.
