Hi,

 

I wasn't able to find an answer to my specific situation, so I'm asking here....

 

We just sent our AOS application package this week.

 

Regarding the DS-3025.......my husband had his medical last December 2018 and brought his yellow immunization record and 2 papers from the doctor for the injections.  My husband wasn't given a DS-3025 but he did receive all injections.  We included copies of his immunization record and 2 papers with injection info and payment, inside the AOS application package.

 

He said the doctor only gave him a yellow envelope with his chest x-ray and CD, but there wasn't a DS-3025 or any paperwork inside.  The other yellow envelope was for POE which my husband handed over at POE in San Francisco.

 

Is the DS-3025 inside  the yellow envelope that he handed over to the officer at POE which is then sent to USCIS?   

 

I followed the guide here on VJ but it doesn't say anything about sending a DS-3025.

02/03/19  -  ISSUED - Visa in hand same day  :thumbs:

02/13/19 -  Arrived in US :goofy:

03/04/2019  -  Married  🤵👰❤️

04/16/2019  -  Sent AOS packet

05/22/2019. -  Bio fingerprints

06/25/2019. - Case ready for interview

09/23/2019. - EAD approved

09/27/2019  - EAD card received

The DS-3025 should've been in the package with his passport and visa. That is the proof that you completed the medical (or not, in which case he might have to get a new medical for AOS interview)

When you're talking about papers from the doctor for the injections and the immunization record, I assume you're talking about documents he got from a local doctor, not the doctor who did the medical?

 

Double check the envelope he got where his passport with visa was in. If it's not in there, contact the doctor that did the medical in his home country to get a copy of the DS-3025.

He said the same doctor gave him the physical and the injections.  He said there wasn't any paperwork/DS3025 with his passport and visa or with the chest xray and CD.

 If the DS3025 is included in the sealed yellow envelope  handed over to the officer at POE, then I don't see why we would get an RFE for it?

He should have gotten a copy of the DS-3025 in his envelope. Double check the cover where the CD came in. My DS-3025 was folded into the cover, at first I thought I didn't get it either. If it's not in there, contact the doctor that did the medical in his home country to get the copy.

We checked everything, he didn't get a copy of it so he will have to contact the doctor. 

 

But my question is  - is it also in the sealed yellow envelope that he handed to the officer at POE that then gets sent to USCIS?  If it is, then why would  we get an RFE for it in our AOS application?

No one knows what's in there, its sealed (or maybe some people took a peek and got it resealed, I'm not one of those people, so I can't answer that question)

 

You might get an RFE since you can't provide the DS-3025, no matter if USCIS has a copy already or not. If you can't prove you had your medical completed (and you can proof that if the DS-3025 is marked as complete), they have the right to RFE you at the interview. 

They also might have a copy of it and don't give you a hard time. But if you want to avoid the RFE, just contact the doctor and get a copy. Again, he should have got it in his package like everyone else (unless Algeria doesn't do it, but I highly doubt they would not provide the copy), but sometimes they forget it.

He will contact the doctor for a copy, but we already sent the AOS packet........we'll see if we get an RFE at any point.

The information including information about immunizations is supposed to be in the sealed envelope. If you can get a copy then great, USCIS already has everything from the medical. Good luck.
