K1 SELF-EMPLOYED PETITIONER - BELOW MINIMUM INCOME REQUIREMENT

Hi Guys,

 

We are on the process of filing our petition for K1 only to find out that my F's adjusted income (as per his latest Income Tax Return) was below minimum income requirement of K1 visa.

Just a quick facts about him: He's a Filipino by birth, son of a naturalized U.S citizen and he automatically became U.S citizen when he came to U.S at the age of 12.

He is self-employed; resides in California, and doesn't have any dependents (children) yet.

Here are my questions:

 

1.  Is there any alternative option we can do to proceed with the petition? like joint sponsorship? We're planning to apply the K1 visa in Abu Dhabi since I'm currently residing in UAE.

Will they accept it?

2.  Is Beneficiary's birth certificate required to be included in the K1 packet or only upon interview?

3.  On the Citizenship Information, will he tick Naturalization or U.S citizen parents? Aside from U.S passport, which document does he need to provide- Certificate of Naturalization or Certificate of Citizenship?

Not sure if Abu Dhabi accepts co-sponsors for K1s, but that is really the only option if he does not meet the income requirements.

I remember including it with the I129F submission.

Naturalized, since he was not a USC from birth and received that through his parents naturalization.

Just to add to this - we did not include my (the beneficiary’s) birth certificate with our application - it isn’t listed as required in the guide - and our petition was approved. My understanding is that the I129F is mainly about the petitioner - when I go to the interview, I will need to take my birth certificate then 🙃.

3) does he have a us passport?
