Hello, I've been planning to apply for a US tourist visa here in Abu dhabi. I have been denied last 2014 with my siblings. I believe we did not convince the officer on our ties.

 

Now I am here in UAE as a nurse for 3years. I've travelled to Japan, Armenia, Georgia, Singgapore, Macau and HK. My resident visa here is still valid until 2021.

 

My mom (80 y.o) and 3 older siblings are in the U.S, my problem is that one of my sister is out of status. Will it affect my application? Also being a nurse would hinder me from getting a visa?

Why would it?

 

The biggest hindrance for you will be the presence of family in the US, and......are you originally from someplace else?  What are your ties to UAE?  Being an overseas worker in UAE shows that you're more mobile than most, and might seek to overstay.

 

Past travel history is fine, but you still need to show strong ties to home to convince them that you won't overstay.

 

A sibling out of status shouldn't make a difference, imho.

Being a nurse isn't indicative of being a problem. It's not like you can just work illegally as a nurse in the US...nobody will hire a nurse without checking work authorization or without proper licensing. The employer would be open to severe liabilities.

 

Having US-based immediate relatives is a strong tie to the US, which is not good...you want ties to return home, not ties to stay.

Having a close family member that has overstayed is not helpful IMO...the presumption being that you may do the same.

 

Either way, apply and find out. Nobody knows what they will decide beforehand. If you don't apply, the chance is 0% of getting it.

Hi, thank you for the response. I will try to apply mid this year, hopefully i'll be granted with a visa.

I have a well paying job here. My only ties in philippines is that i still have my 2 other siblings. I'm single with no kids. 

 

My younger sister (also a nurse) who lives in New zealand will also try to apply, we plan to do it in the same time.

For both of you, the burden is on you to demonstrate ties to *home* (wherever that may be).  COs interviewing for visitor visas are required by law to assume immigrant intent by the applicant.  It is your job to prove otherwise.

Did your sister went to the US on b2 Visa and overstayed that's why she's out of status? Consul might suspect that you'll do the same thing

No, i think she was on H1b 20years ago, im not really sure. As far as i know she pays her taxes and has ssn.

Eh doesnt matter, she is still there illegally and since you need to mention her in your application, it wont look good.

Having a sibling illegally in the US and being supported by other family members is obviously an issue.

 

I assume the OP is from the Philippines.

 

There are plenty of unofficial opportunities for people with nursing qualifications.
