Question from my US spouse:

I am the sponsor about to submit my 864EZ and supporting documents. I have my IRS tax transcript from 2018 as well as my 1040s from 2016-2018. In 2018 I had two W2s and one 1099. I cannot get ahold of the company to get a copy of my 1099. I was able to file my taxes without my 1099 so I already knew the amount I earned which was needed to file.  

I’m hoping someone has been in this situation and can help me out - Different places on the 864EZ instructions and the form are giving me conflicting information. If I have my IRS transcript will that suffice as evidence of income? I’m just thinking what’s the point of submitting 2 W2’s but not my 1099. 

Will my IRS transcript be enough or are W2s/1099 mandatory? Again I am receiving conflicting info, eventhough I see the official guide says the following:

Finally: the above doesnt state this but have read that many write to attach evidence of my US citizenship as well. Do I need to?

No W2 is needed with a tax return transcript, also no 1099.  Evidence of citizenship is for joint sponsors.  Your status is already established.  Study those I-864EZ instructions IN CONTEXT.

You should provide your tax return transcripts.  Your income needs to pass the I-864P poverty guidelines on w2s alone (without 1099).  Also pay stubs help as evidence of current income.

 

I went to interview with I-864ez, 3 years of tax return transcripts, 6 months of pay stubs, and the tax return extension for the year that I interviewed.

September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)

October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)

November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
