Hello,

I have not been able to find answer for our situation, hence I have to create a new topic hoping someone might offer any advice or share similar experience on how they dealt with this

 

So, we filed our I-751, we got our extension letter and my spouse left country as she had to attend a wedding back home. Reading around these forums, we got the sense that this will be a long process so no worries. A week after she left, we get the Biometrics letter with apt on 4/17th. My spouse is coming back on May 7th. Obviously, we rescheduled it. We have read on this forum that usually they reschedule it after ~2-3 weeks from the original appointment date. We were hoping its 3 weeks that would put us right the next day she lands. Well, they gave it after 2 weeks and her new appointment is on 5/3. Should I just request to reschedule it again? I have read on a different website that multiple rescheduling might result in Denial due to failure to do biometrics.

 

Has anyone else dealt with this situation and what did they end up doing? I can't ask her to come back sooner since the tickets are extremely expensive. Appreciate any advice or feedback

I'd like to add we live in Michigan and are dealing with Texas service center

Mar 5, 2021:  Interview scheduled for April 16, 2021.

Apr 16, 2021:  Interview in Portland, OR. Refused entry to USCIS office due to have traveled abroad in the past 10 days. No interview. However, a few hours after refusal, received notice of approval and card produced!  

Apr 20, 2021:  Card mailed! "On April 20, 2021, we mailed your new card for your Form I751, PETITION TO REMOVE CONDITIONS ON RESIDENCE"

So, you have received two I-797C, Notice of Action, from the USCIS Application Support Center (ASC). That may be your local USCIS Field Office, check you're notice.

 

Generally rescheduling a Biometrics appointment can be done, though I suspect that the scheduling minions at the Alexandria, Virginia ASC (that is the ASC noted on our I-797C notice, yours may be different.) are likely not very happy to try to re-juggle appointments once, let alone twice, and who knows about three times. The danger here is if they reschedule you and you don't get the notice and you don't show up for the interview, there can be serious consequences for your case. As mentioned on the form, in capital letters, "IF YOU FAIL TO APPEAR AS SCHEDULED, YOUR APPLICATION WILL BE CONSIDERED ABANDONED." Keep in mind, that this is still their ball game, their ball, their playing field, and their rules. You can play, but it is according to their rules. These forums are full of stories where notices and letters from USCIS get lost in the mail, or undelivered for whatever reason. In the end, the onus is on the beneficiary to try to make it right. I would suggest that you quit tempting fate.

 

When my family were scheduled to give their Biometrics, I took the day off of work, and drove them to the prescribed location, and made sure to get them there early. After all we had gone through, we did not want to screw it up at this late stage of the process.
