Hi, 

I am so close to get my final interview for the biometric oath after over three years process, my paperwork is with the consulate of Montreal and I was advised on Apr 4/19 via email to schedule an appointment  on the website https://ais.usvisa-info.com/en-ca/iv. It has been impossible to schedule an appointment since then, I was advised twice to keep checking everyday until the dates are released, nothing yet no information no options.  I am very concerned of how much longer I will need to wait to schedule an appointment, I have some family matters to take care of in the USA, the main one is my husband needs to get a foot surgery and this is well overdue, .  he really needs me to help him on the recovery of almost a month, I was hoping to be in the US by now, since my waiver was approved on Jan 5/19 . I was wondering if I am able to travel as a visitor, I have a Canadian Passport and supposedly I don´t need a visa to visit the USA, however I had a past problem and a misunderstanding years ago and had to wait for a waiver to be approved and I have this now, with this in place I am not sure if I am able to visit the USA and then go to the Montreal consulate when I have an appointment date and have my residence. Is there anyone that know about a similar situation? The consulate is aware of this but they haven´t replied yet to this.

You don't normally need a visa as a Canadian, but if you have an ineligibility that requires a waiver, you usually need to have a visa that documents the approved waiver.  More importantly, you have to show non-immigrant intent, whether a visa is required or not.  Entering the US with the intent of leaving only to go to your immigrant visa interview makes it impossible to demonstrate non-immigrant intent and is likely to/should result in a denial of entry.

Thank you jan22 for your input, I understand what you mean.  I wouldn't have the intent of moving right away but obtaining a permission to stay for a short period of time. A month will be enough. I was wondering if I can have an employment letter that confirms the non immigrant intent. I am just so close but also very uncertain as to when I will finish the process. Just trying to reach the proper government department that can help me to find a way, before it's too late to do anything. I need to be in the USA for 4 weeks between mid May to mid June. Thanks again!

@Diana1225 Have you had any luck with the appointment yet? We have also been asked for a re-oath and have been trying for over a week, but all I get is no appointments are available message. If you did get it, can you share how long you have had to wait? I am concerned about the validity of our medical results - we have already had to take it 3 times.

Hello dazzler1234,

 

I was finally able to set up an appointment on June 4, after trying for 8 weeks. I checked the website every day and several times a day. There were only 4 dates available in August and got one of them. 

 

It seems the medical exams are good for 6 months.

@dazzler1234 have you had any luck getting an appointment booked?  I received a request to book an appointment for bio metrics and re-oath  on June 11th.  I've been trying daily, several times a day and the only response I get is "no appointments available".

 

I see that Diana1225 got an appointment - so maybe there is hope.  I am worried my new medical will expire at this rate....

@Rose7673 No luck still and I try every day several times too. I send an email to Montreal consulate and they said they don't manage appointments and to call AIS. I called AIS and they said Montreal is supposed to open up appointments so it feels like we have no option but to wait and hope it becomes available. Let's try and inform each other if we either of us see any dates open up.

I hope you get the appointment very soon. I sent an email to Montreal consulate as well several times and to the technical support email for ais, no answers here, both places keep telling you to wait. I really recommend to check the site at least three times a day. The day I got the appointment I had checked  in the morning and no appointments were available, I felt prompted to check at noon and that's when I saw  four  dates available, they lasted about 2 business days after that.

I would call AIS, however I understand that you need to have a letter or email from the consulate instructing you to make an appointment. AIS makes available this option so you can make the appointment on the website based on the instructions given by the consulate. On the website you need to answer the question whether you received a letter or not.

Hello! 

 

I have my last scheduled appointment for the bio metric oath in Montreal on Aug 9/19 (Friday), is there anybody who knows how long the consulate takes to give you the visa /PR physically after the bio-metric oath appointment? I am planning to stay in Montreal to wait up for it, hopefully it takes just a few business days to pick it up in one of the Canada Post offices designated.

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
