Ok got it. So the agency that currently has your case is the US Embassy (which is under the Department of State).

Ok;  I will advice the petitioner to seek help from House Reps, Senators and Ombudsman first before taking the drastic step to pursue WoM.

I would talk to a lawyer and see what he suggests. But this familys lawyer did just that. If it were me, I would reach out to my local Congressman first.

You have a basis for a lawsuit. You paid an agency to adjudicate your case, fulfilled all their requirements, and they are not carrying out their duty. You have a right to sue.

 

They can approve or reject or request further evidence.

It takes them a few hours to learn EVERYTHING about you. If it has been sitting for three years means they are not even looking at it.

One other thing. If you do decide to go the path of a WoM, can I encourage you to update us here on this website of your progress and result? We often have members mention filing WoM cases but we get very few follow ups on what was the outcome. This is a simple request and, of course, no obligation to you. But your experience with this would greatly contribute to the board and help others who are thinking about doing the same.

Sue now and lose means you get to start all over if you want to come to the US.   

 

Use the ombudsman and congressional options first.

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
