I've read through the guides and FAQs for K-1 visas. My fiance received his a couple of months ago and we will be traveling to the US together in July. We would like to marry as soon as possible once arriving to get the whole stateside process moving (esp. considering the marriage certificate can take some time to be issued). We will be in North Carolina and it seems they ask for the SS# of both parties before issuing a marriage license.

My question is this -- can we get the marriage license and get married BEFORE he gets his social security card (which would postpone things about a month)?

Hoping for the most expeditious process to work authorization and adjustment of status, KADIA

usually you can apply for a ssn before you get married. but you should give them 2 weeks to enter your datas into their system.

As for the marriage license you should get it right away.

We did not need the SSN to apply for the license so it was easier to apply for the ssn after getting married because you will apply with your new name as well (if it applies to you)

Make sure you really need the SSN for the license because I have heard some cases it took a while to get the SSN, which means you might loose a few more weeks until you can get married!

I've been wondering the same things. I'll keep an eye on this tread.

I also wanted to tell you to be sure and call the clerk of courts in your county in NC first. In my parish (same as a county) in Louisiana the website says that they need SSN from both parties (and that it take 30-40 days to get a certified copy of the marriage certificate). I called to see if we could just use my fiancee's passport. The person I spoke with told me that we would have to appear before a judge and he/she could waive my fiancee's SSN and birth certificate requirement if he presents the court with him valid passport & K1. Whats more she even said that the same judge could waive the 72 hour waiting period, marry us, and she could issue us a certified copy of our marriage certificate the same day; if we arrive at start of business we'd most likely be done by lunch time.

Just be sure to call to double check. I'm glad I did!

It gives you the requirements for each state to get a marriage license and like Ninetok said, your finace can sign a waiver saying he has no SSN.

NC does not require to have a SSN. At the register of deeds you can sign a waiver explaining why you don't have a SSN. Call your local reg of deeds to get confirmation, at least last July when we got married those rules applied. :)

There are a couple of counties in NC that'll give you a hassle if you don't have an SSN, but by law they don't require it of non-US citizens. As stated above, all he'll need to do is sign the waiver. I recall at least one NC couple who got the run around in their county for a couple of weeks before a clerk dusted off the file folder with the waivers in it.

We got married in Caldwell county no problem. However, they did decide that "Canadian" is a different race, so when I had checked the box that said "white" she scratched it out, marked the "Other" box and wrote in Canadian. :wacko::lol:

I live in SC but I got married in North Carolina (Mecklenburg Co.) for the very reason that they do not require a SSN to get married. My fiance' signed an Affidavit that she did not have a SSN right there in the Register of Deeds where we made application for a marriage license.

In SC, you can NOT get married without an SSN.

Got married in Wake county (Raleigh) February this year. A SSN is not required. Also you can get the marriage license the same day as you apply. You can go on line to fill out the information ahead of going down to the office. Take the passport with the Visa for your fiancee. We did not have any problems.

I'm moving to NC this summer as well on a K-1.

I emailed the county clerk in Jackson County NC, where my fiance is from, and explained that I would like to get married before I'd get my SSN, as it'd take between 10-14 days to get it and I'm planning on getting married in less than that.

That wasn't a problem, there's just an affidavit that's needed to sign, stating that a SSN isn't available. The clerk offered to mail it to my fiances house, so now it's just there waiting for me to arrive :)

When my spouse and I married in NC, he was here on the visa waiver program. We got the license on a Friday afternoon and were married that Sunday. All he had with him at the time was his swedish passport. We got married in the county I lived in though so I dont know if that makes a difference or not.
