E3D Visa - Marriage Certificate

Hi All,

 

I've been googling like a mad man but can't seem to find any information on this particular issue, so I'm hoping someone here can help!

 

I'm an Australian citizen planning to apply for an E3 visa (I satisfy all the requirements). However, my girlfriend (de-facto living together for 3 years) is Swedish and there are no work visas that she is eligible for.

 

I understand that the US does not recognise de-facto relationships for visa purposes, hence our plan is to file for a marriage certificate to allow her to obtain an E3D visa on the back of my E3 visa. 

 

Unfortunately, we are flying out of Australia in about 20 days and the processing time for a marriage certificate in our state is about 50 days (yes i know, poor planning!). 

 

My query is if the marriage certificate needs to be from the country of the E3 visa holder (Australia) or can the certificate be from any country (Sweden or USA)?

Not sure how a jurisdiction would generate a marriage certificate for someone in a bf/gf type relationship, unless the two of you actually marry. When you marry, the jurisdiction in which the wedding is solemnized issues the registration that carries the wedding officiant's signature. That wedding registration is recognized the world over.

WeGuyGal sorry mate I wasn’t too clear! Yes we plan to get married. And you have answered my question, the certificate can be from any jurisdiction. I was worried that it needed to be from the country of the E3 applicant. Cheers!
