My boyfriend has an interview with the UK Embassy on Wednesday. He is filling out the DS-156. On line 26 it asks how long he intends to stay... If he only puts down 2 weeks then will the embassy only make his Visa for 2 weeks..??????????????????.Cause if he puts in 6 months... then the embassy will deny him saying "he dosnt show enough ties to his home country and it will look like he is trying to move here"

We want to be together really bad, and this is STRESSING us both out VERY much !!! Should we just put on there that he plans to stay to get married....then what if we dont get married....or what if we do....and he dosnt put that on the form

am i rambling ???? this is my first experience with this.....i dont know what to do ???

The DS 156 is used for all non-immigrant visa applications, many of which are granted for short stays. The K1 visa is issued for a 90 day stay and requires you marry during that 90 days or the visa holder leaves the US.

I would put "permanent" in 26 and in 27 put "marriage and adjustment of status to permanent resident" or simply "marriage" and note you are applying for a K1 visa. They'll understand what they need to understand.

as far as i understand, they didnt file for a k1 visa cause you have to fill out the ds 156 after getting packet 3 form the us embassy in your homecountry before you are even scheduled for an interview. but apparently he already got an interview appointment next week. so i guess its just for a tourist visa to visit his girlfriend!

why do you even file for a visa? your boyfriend can stay in the states for 90 days under the visa waiver programm without having to file for a visa! if he wants to stay longer he has to file for a specific visa type, lets say to study or work there.

its really hard or even impossible for non us citiziens to obtain a visa for a longer period of time without having a job over there or studies.

unless you file for K3( spouse visa, if youre already married to a usc) or a k1 (fiance visa) visa.

We really need more details to answer your question. As you've been told, for K1 the visa is 90 days and you MUST marry during that time. If its just for a tourist visa, I dont understand why you are applying for it in the first place. You can't enter the US with the intent to marry and stay on a touist visa. You can marry and then return home and file for K3.

OK Thank you for replying, He cant get on the visa waiver program because last time he was here he overstayed, and now they wont let him back without a visitors visa !! I cant get him over here yet on a k-1 or k-3, because my divorce wont be final until around June 6...

Im having a feeling that we arnt going to have enough proof of our relationship from May 31---Sept 1 2006.....in order to get him here on the K-1 or K-3

I hope this clears things up a bit !! Any suggestions ??

pattilou47,

He should answer the question as asked - how long does he intend to stay in the USA?

Q26 has nothing to do with how long the visa will be valid for - length of stay allowed in the USA will be determined by the CBP officer who grants him entry. The length of time that the visa will be valid for will be more dependent on the answer to DS-156 Q22.
